Marriage with a Woman and ‘Umm Walad of Her Father
6 Aḥadīth

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ أَبِي الْحَسَنِ الرِّضَا (a.s) قَالَ سَأَلْتُهُ عَنِ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ وَيَتَزَوَّجُ أُمَّ وَلَدِ أَبِيهَا فَقَالَ لا بَأْسَ بِذَلِكَ فَقُلْتُ لَهُ بَلَغَنَا عَنْ أَبِيكَ أَنَّ عَلِيَّ بْنَ الْحُسَيْنِ (عَلَيْهِما السَّلام) تَزَوَّجَ ابْنَةَ الْحَسَنِ بْنِ عَلِيٍّ (عَلَيْهِما السَّلام) وَأُمَّ وَلَدِ الْحَسَنِ وَذَلِكَ أَنَّ رَجُلا مِنْ أَصْحَابِنَا سَأَلَنِي أَنْ أَسْأَلَكَ عَنْهَا فَقَالَ لَيْسَ هَكَذَا إِنَّمَا تَزَوَّجَ عَلِيُّ بْنُ الْحُسَيْنِ (عَلَيْهِما السَّلام) ابْنَةَ الْحَسَنِ وَأُمَّ وَلَدٍ لِعَلِيِّ بْنِ الْحُسَيْنِ الْمَقْتُولِ عِنْدَكُمْ فَكَتَبَ بِذَلِكَ إِلَى عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ فَعَابَ عَلَى عَلِيِّ بْنِ الْحُسَيْنِ (عَلَيْهِما السَّلام) فَكَتَبَ إِلَيْهِ فِي ذَلِكَ فَكَتَبَ إِلَيْهِ الْجَوَابَ فَلَمَّا قَرَأَ الْكِتَابَ قَالَ إِنَّ عَلِيَّ بْنَ الْحُسَيْنِ (عَلَيْهِما السَّلام) يَضَعُ نَفْسَهُ وَإِنَّ اللهَ يَرْفَعُهُ.


1. Ali ibn Ibrahim has narrated from his father from Ahmad ibn Muhammad from ibn abu Nasr who has said the following: “I once asked al-Rida’ (a.s), about the case of a man who marries a woman then marries the mother of the child of her father. He (the Imam) said, ‘It is not unlawful.’ I then asked, ‘It is narrated to us from your father (a.s), that Ali ibn al-Husayn (a.s), married, daughter of al-Hassan ibn Ali (a.s), and mother of the child of al-Hassan because a certain person of our people asked me to ask you about it. He (the Imam) said, ‘It is not that way. Ali ibn al-Husayn (a.s), had married daughter of al-Hassan (a.s), and mother of the child of Ali ibn al-Husayn who was murdered with you. It was reported to ‘Abd al-Malik ibn Marwan who blamed Ali ibn al-Husayn (a.s), about it and Ali ibn al-Husayn (a.s), wrote to him the answer. After reading the letter he said, ‘Ali ibn al-Husayn lowers himself but Allah raises him up.’”

2- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ مُحَمَّدِ بْنِ سِنَانٍ عَنْ أَبِي الْحَسَنِ (a.s) قَالَ سَأَلْتُهُ عَنِ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ وَيَتَزَوَّجُ أُمَّ وَلَدٍ لأبِيهَا قَالَ لا بَأْسَ بِذَلِكَ.


2. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Muhammad ibn Sinan who has said the following: “I once asked abu al-Hassan (a.s), about the case of a man who marries a woman and a mother of the child of her father. He (the Imam) said, ‘It is not unlawful.”’

3- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنِ الْحَسَنِ بْنِ عَلِيٍّ الْكُوفِيِّ عَنْ عَبْدِ اللهِ بْنِ جَبَلَةَ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِي الْحَسَنِ (a.s) قَالَ سَأَلْتُهُ عَنِ الرَّجُلِ يَهَبُ لِزَوْجِ ابْنَتِهِ الْجَارِيَةَ وَقَدْ وَطِئَهَا أَيَطَؤُهَا زَوْجُ ابْنَتِهِ قَالَ لا بَأْسَ بِهِ.


3. Abu Ali al-Ash’ariy has narrated from al-Hassan ibn Ali al-Kufiy ibn Jabalah from Ishaq ibn ‘Ammar who has said the following: “I once asked abu al-Hassan (a.s), about the case of a man who gives as a gift his slave- girl with whom he has gone to bed, to his son in-law; if his son in-law can go to bed with this slave- girl. He (the Imam) said, ‘It is not unlawful.’”

4- عَنْهُ عَنْ عِمْرَانَ بْنِ مُوسَى عَنْ مُحَمَّدِ بْنِ عَبْدِ الْحَمِيدِ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ قَالَ كُنْتُ عِنْدَ الرِّضَا (a.s) فَسَأَلَهُ صَفْوَانُ عَنْ رَجُلٍ تَزَوَّجَ ابْنَةَ رَجُلٍ وَلِلرَّجُلِ امْرَأَةٌ وَأُمُّ وَلَدٍ فَمَاتَ أَبُو الْجَارِيَةِ أَيَحِلُّ لِلرَّجُلِ الْمُتَزَوِّجِ امْرَأَتُهُ وَأُمُّ وَلَدِهِ قَالَ لا بَأْسَ بِهِ.


4. It is narrated from the narrator of the previous Hadith from ‘Imran ibn Musa from Muhammad ibn ‘Abd al-Hamid from Muhammad ibn al-Fudayl who has said the following: “Once I was with al-Rida’ (a.s), when Safwan asked about a man who has married the daughter of a man and the man has a woman and a mother of child. The father of the girl dies; if this man can marry the wife and mother of the child of the deceased. He (the Imam) said, ‘It is not unlawful.’”

5- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنِ الْحَسَنِ بْنِ عَلِيٍّ الْكُوفِيِّ عَنْ عُبَيْسِ بْنِ هِشَامٍ عَنْ مُحَمَّدِ بْنِ أَبِي حَمْزَةَ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (a.s) مَا تَقُولُ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَأَهْدَى لَهَا أَبُوهَا جَارِيَةً كَانَ يَطَؤُهَا أَيَحِلُّ لِزَوْجِهَا أَنْ يَطَأَهَا قَالَ نَعَمْ.


5. Abu Ali al-Ash’ariy has narrated from al-Hassan ibn Ali al-Kufiy from ‘Ubays ibn Hisham from Muhammad ibn abu Hamzah who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s), about the case of a man who marries a woman and her father gives her a slave-girl with whom he has gone to bed, as a gift; if her husband can go to bed with the slave-girl. He (the Imam) said, ‘It is not unlawful.’”

6- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ أَبِي أَيُّوبَ عَنْ سَمَاعَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (a.s) عَنْ رَجُلٍ تَزَوَّجَ أُمَّ وَلَدٍ كَانَتْ لِرَجُلٍ فَمَاتَ عَنْهَا سَيِّدُهَا وَلِلْمَيِّتِ وَلَدٌ مِنْ غَيْرِ أُمِّ وَلَدِهِ أَرَأَيْتَ إِنْ أَرَادَ الَّذِي تَزَوَّجَ أُمَّ الْوَلَدِ أَنْ يَتَزَوَّجَ ابْنَةَ سَيِّدِهَا الَّذِي أَعْتَقَهَا فَيَجْمَعَ بَيْنَهَا وَبَيْنَ بِنْتِ سَيِّدِهَا الَّذِي أَعْتَقَهَا قَالَ لا بَأْسَ بِذَلِكَ.


6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from abu Ayyub from Sama‘ah who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s), about the case of a man who marries the mother of the child of a man and her master dies. The deceased has a child from a woman other than his mother of the child; if the man who has married the mother of the child can marry the daughter of her master who has set her free so he will have both the daughter of the master who set her free and the slave-girl. He (the Imam) said, ‘It is not unlawful.’”
