Chapter on What Is Lawful for Banu Hashim and Unlawful from Zakat

Commentary 1

قال الشيخ رحمه الله:) وتحرم الزكاة الواجبة على بني هاشم جميعا من ولد أمير المؤمنين عليه السلام وجعفر وعقيل والعباس رضي الله عنهم إذا كانوا متمكنين من حقهم في الخمس من الغنائم فإذا منعوه واضطروا إلى الصدقة حلت لهم الزكاة وتحل لهم صدقة بعضهم على بعض وجميع ما يتطوع به عليهم من الصدقات(. الذي يدل على ان الزكاة المفروضة لا تحل لهم

The Shaykh (Al-Mufid), may Allah (swt) have mercy on him, said: “The obligatory zakat is unlawful for all of Banu Hashim, from the descendants of the Commander of the Faithful, Imam Ali ibn Abi Talib (a.s), peace be upon him, And Ja‘far (ibn Abi Talib), and Aqil (ibn Abi Talib), and al-Abbas (ibn Abd al-Muttalib), may Allah (swt) be pleased with them, when they are able to access their right in the khums from the spoils of war (ghanimah). But if they (Banu Hashim) are prevented from it (khums) and are compelled to charity, then zakat becomes lawful for them. The charity of some of them (Banu Hashim) to others is lawful for them, as is everything voluntarily given to them from charities.” That which indicates that the obligatory zakat is not lawful for them.

Hadith 1

مُحَمَّدُ بْنُ يَعْقُوبَ عَنْ أَحْمَدَ بْنِ إِدْرِيسَ عَنْ مُحَمَّدِ بْنِ عَبْدِ اَلْجَبَّارِ وَ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنِ اَلْفَضْلِ بْنِ شَاذَانَ جَمِيعاً عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ عِيصِ بْنِ اَلْقَاسِمِ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» إِنَّ أُنَاساً مِنْ بَنِي هَاشِمٍ أَتَوْا رَسُولَ اَللَّهِ صَلَّى اَللَّهُ عَلَيْهِ وَآلِهِ فَسَأَلُوهُ أَنْ يَسْتَعْمِلَهُمْ عَلَى صَدَقَاتِ اَلْمَوَاشِي وَ قَالُوا يَكُونُ لَنَا هَذَا اَلسَّهْمُ اَلَّذِي جَعَلَ اَللَّهُ عَزَّ وَجَلَّ لِلْعَامِلِينَ عَلَيْهَا فَنَحْنُ أَوْلَى بِهِ فَقَالَ رَسُولُ اَللَّهِ صَلَّى اَللَّهُ عَلَيْهِ وَآلِهِ» يَا بَنِي عَبْدِ اَلْمُطَّلِبِ إِنَّ اَلصَّدَقَةَ لاَ تَحِلُّ لِي وَ لاَ لَكُمْ وَ لَكِنِّي قَدْ وُعِدْتُ اَلشَّفَاعَةَ«« ثُمَّ قَالَ أَبُو عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ» اِشْهَدُوا لَقَدْ وُعِدَهَا فَمَا ظَنُّكُمْ يَا بَنِي عَبْدِ اَلْمُطَّلِبِ إِذَا أَخَذْتُ بِحَلْقَةِ بَابِ اَلْجَنَّةِ أَتَرَوْنِي مُؤْثِراً عَلَيْكُمْ غَيْرَكُمْ«.

Muhammad ibn Yaqub, from Ahmad ibn Idris, from Muhammad ibn Abd al-Jabbar and Muhammad ibn Ismail, from al-Fadl ibn Shadhan, all of them from Safwan ibn Yahya, from Is ibn al-Qasim, from Abu Abdillah (a.s), peace be upon him, who said: Imam (a.s) said: “Indeed, some people from Banu Hashim came to the Messenger of Allah (swt), may Allah (swt) bless him and his family, and asked Him (saws) to appoint them over the charities of the livestock. They said: “This share which Allah (swt), Mighty and Majestic, has assigned for those who work over it would be for us, and we are more entitled to it.” So the Messenger of Allah (swt), may Allah (swt) bless him and his family, said: “O Banu Abd al-Muttalib, charity is not lawful for Me (saws) nor for you, but I have been promised intercession.” Then Abu Abdillah (a.s), peace be upon him, said: “Bear witness, the Prophet (saws) was certainly promised it (intercession). So what do you think, O Banu Abd al-Muttalib, when I take hold of the ring of the gate of Paradise? Do you see me preferring others over you?”

Hadith 2

وَ عَنْهُ عَنْ عَلِيِّ بْنِ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادٍ عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ وَ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ وَ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالاَ:» قَالَ رَسُولُ اَللَّهِ صَلَّى اَللَّهُ عَلَيْهِ وَآلِهِ:» إِنَّ اَلصَّدَقَةَ أَوْسَاخُ أَيْدِي اَلنَّاسِ وَ إِنَّ اَللَّهَ حَرَّمَ عَلَيَّ مِنْهَا وَ مِنْ غَيْرِهَا مَا قَدْ حَرَّمَهُ فَإِنَّ اَلصَّدَقَةَ لاَ تَحِلُّ لِبَنِي عَبْدِ اَلْمُطَّلِبِ« ثُمَّ قَالَ» أَمَا وَ اَللَّهِ لَوْ قَدْ قُمْتُ عَلَى بَابِ اَلْجَنَّةِ ثُمَّ أَخَذْتُ بِحَلْقَتِهِ لَقَدْ عَلِمْتُمْ أَنِّي لاَ أُوثِرُ عَلَيْكُمْ فَارْضَوْا لِأَنْفُسِكُمْ بِمَا رَضِيَ اَللَّهُ وَ رَسُولُهُ لَكُمْ« قَالُوا رَضِينَا«.

And from him, from Ali ibn Ibrahim, from his father, from Hammad, from Hariz, from Muhammad ibn Muslim and Zurarah, from Abu Ja’far (a.s), peace be upon him, and Abu Abdillah (a.s), peace be upon him, who both said: Imam (a.s) said: “The Messenger of Allah (swt), may Allah (swt) bless him and his family, said: ‘Indeed, charity is the impurities of the hands of the people, and indeed Allah (swt) has forbidden for me from it, and from other than it, what He (azj) has forbidden. For charity is not lawful for Banu Abd al-Muttalib.” Then the Prophet (saws) said: “Indeed, by Allah (swt), if I were to stand at the gate of Paradise and then take hold of its ring, you would certainly know that I do not prefer others over you. So be pleased for yourselves with what Allah (swt) and His Messenger (saws) are pleased with for you.” They (Banu Abd al-Muttalib) said: “We are pleased.”

Hadith 3

اَلْحُسَيْنُ بْنُ سَعِيدٍ عَنِ اَلْقَاسِمِ بْنِ مُحَمَّدٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ إِسْمَاعِيلَ بْنِ اَلْفَضْلِ اَلْهَاشِمِيِّ قَالَ: سَأَلْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنِ اَلصَّدَقَةِ اَلَّتِي حُرِّمَتْ عَلَى بَنِي هَاشِمٍ مَا هِيَ فَقَالَ» هِيَ اَلزَّكَاةُ« قُلْتُ فَتَحِلُّ صَدَقَةُ بَعْضِهِمْ عَلَى بَعْضٍ قَالَ» نَعَمْ«.

Al-Husayn ibn Said, from al-Qasim ibn Muhammad, from Hammad ibn Uthman, from Ismail ibn al-Fadl al-Hashimi, who said: I (narrator) asked Abu Abdillah (a.s), peace be upon him, about ‘the charity which was forbidden for Banu Hashim, what is it?’ Imam (a.s) said: “It is zakat.” I (narrator) asked: “Then is the charity of some of them (Banu Hashim) lawful for others among them (other Banu Hashim)?” Imam (a.s) said: “Yes.”

Hadith 4

سَعْدُ بْنُ عَبْدِ اَللَّهِ عَنْ مُوسَى بْنِ اَلْحَسَنِ عَنْ مُحَمَّدِ بْنِ عَبْدِ اَلْحَمِيدِ عَنِ اَلْفَضْلِ بْنِ صَالِحٍ عَنْ أَبِي أُسَامَةَ زَيْدٍ اَلشَّحَّامِ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ: سَأَلْتُهُ عَنِ اَلصَّدَقَةِ اَلَّتِي حُرِّمَتْ عَلَيْهِمْ فَقَالَ» هِيَ اَلزَّكَاةُ اَلْمَفْرُوضَةُ وَ لَمْ تُحَرَّمْ عَلَيْنَا صَدَقَةُ بَعْضِنَا عَلَى بَعْضٍ«.

Sa’ad ibn Abdullah, from Musa ibn al-Hasan, from Muhammad ibn Abd al-Hamid, from al-Fadl ibn Salih, from Abu Usamah Zayd al-Shahham, from Abu Abdillah (a.s), peace be upon him, who said: I (narrator) asked Imam (a.s) about ‘the charity which was forbidden for them (Banu Hashim).’ Imam (a.s) said: “It is the obligatory zakat, and the charity of some of us (Banu Hashim) to others among us (Banu Hashim) has not been forbidden for us.”

Hadith 5

مُحَمَّدُ بْنُ عَلِيِّ بْنِ مَحْبُوبٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ اَلْحُسَيْنِ عَنِ اَلنَّضْرِ عَنِ اِبْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» لاَ تَحِلُّ اَلصَّدَقَةُ لِوُلْدِ اَلْعَبَّاسِ وَ لاَ لِنُظَرَائِهِمْ مِنْ بَنِي هَاشِمٍ«.

Muhammad ibn Ali ibn Mahbub, from Ahmad ibn Muhammad, from al-Husayn, from al-Nadr, from Ibn Sinan, from Abu Abdillah (a.s), peace be upon him, who said: Imam (a.s) said: “Charity is not lawful for the children of al-Abbas, nor for their counterparts from Banu Hashim.”

Commentary 2

فأما الذي يدل على ان في حال الضرورة يجوز لهم ذلك ما رواه:

As for that which indicates that in the state of necessity, that is permissible for them, it is what he narrated (in the following hadith):

Hadith 6

عَلِيُّ بْنُ اَلْحَسَنِ بْنِ فَضَّالٍ عَنْ إِبْرَاهِيمَ بْنِ هَاشِمٍ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ زُرَارَةَ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» مَوَالِيهِمْ مِنْهُمْ وَ لاَ تَحِلُّ اَلصَّدَقَةُ مِنَ اَلْغَرِيبِ لِمَوَالِيهِمْ وَلاَ بَأْسَ بِصَدَقَاتِ مَوَالِيهِمْ عَلَيْهِمْ« ثُمَّ قَالَ »إِنَّهُ لَوْ كَانَ اَلْعَدْلُ مَا اِحْتَاجَ هَاشِمِيٌّ وَ لاَ مُطَّلِبِيٌّ إِلَى صَدَقَةٍ إِنَّ اَللَّهَ جَعَلَ لَهُمْ فِي كِتَابِهِ مَا كَانَ فِيهِ سَعَتُهُمْ« ثُمَّ قَالَ» إِنَّ اَلرَّجُلَ إِذَا لَمْ يَجِدْ شَيْئاً حَلَّتْ لَهُ اَلْمَيْتَةُ وَ اَلصَّدَقَةُ وَ لاَ تَحِلُّ لِأَحَدٍ مِنْهُمْ إِلاَّ أَنْ لاَ يَجِدَ شَيْئاً وَ يَكُونَ مِمَّنْ تَحِلُّ لَهُ اَلْمَيْتَةُ«.

Ali ibn al-Hasan ibn Faddal, from Ibrahim ibn Hashim, from Hammad ibn Isa, from Hariz, from Zurarah, from Abu Abdillah (a.s), peace be upon him, who said: Imam (a.s) said: “Their mawali (owned slaves) are from them, and charity from a stranger is not lawful for their mawali, and there is no harm in the charities of their mawali being given to them.” Then Imam (a.s) said: “Indeed, if justice existed, no ‘Hashimi’ (Banu Hashim) nor ‘Muttalibi’ (Banu Abd al-Muttalib) would need charity. Indeed, Allah (swt) has placed for them in His (swt) Book (Quran) that wherein there is their sufficiency.” And Imam (a.s) said: “Indeed, when a man does not find anything, carrion and charity become lawful for him; and it is not lawful for any one of them unless he does not find anything and is among those for whom carrion is lawful.”

Commentary 3

قوله عليه السلام: ولا تحل الصدقة من الغريب لمواليهم فالمراد به إذا كان الموالي مماليك لهم ويلزمهم القيام بنفقاتهم لا يجوز لهم أن يعطوا الزكاة لان المملوك لا يجوز أن يعطى الزكاة، فأما مواليهم الذين ليسوا مماليك فليس بمحرم ذلك عليهم، والذي يدل على ذلك ما رواه:

The Imam (a.s) saying, peace be upon him: “Charity from the stranger is not lawful for their mawali,” what is intended by it is when the mawali are slaves owned by them and it is binding upon them to maintain them; it is not permissible for them to give zakat to them, because it is not permissible for a slave to be given zakat. As for their mawali who are not slaves, that is not unlawful for them. That which indicates this is what he narrated (in the following hadith):

Hadith 7

عَلِيُّ بْنُ اَلْحَسَنِ بْنِ فَضَّالٍ عَنْ جَعْفَرِ بْنِ مُحَمَّدِ بْنِ حَكِيمٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ: سَأَلْتُهُ هَلْ تَحِلُّ لِبَنِي هَاشِمٍ اَلصَّدَقَةُ قَالَ» لاَ« قُلْتُ تَحِلُّ لِمَوَالِيهِمْ قَالَ» تَحِلُّ لِمَوَالِيهِمْ وَ لاَ تَحِلُّ لَهُمْ إِلاَّ صَدَقَاتُ بَعْضِهِمْ عَلَى بَعْضٍ«.

Ali ibn al-Hasan ibn Faddal, from Jafar ibn Muhammad ibn Hakim, from Jamil ibn Darraj, from Abu Abdillah (a.s), peace be upon him, who said: I (narrator) asked Imam (a.s): “Is charity lawful for Banu Hashim?” Imam (a.s) said: “No.” I (narrator) asked: “Is it lawful for their mawali?” Imam (a.s) said: “It is lawful for their mawali, but it is not lawful for them, except the charities of some of them to others among them.”

Hadith 8

فَأَمَّا اَلْخَبَرُ اَلَّذِي رَوَاهُ عَلِيُّ بْنُ اَلْحَسَنِ بْنِ فَضَّالٍ عَنْ عَبْدِ اَلرَّحْمَنِ بْنِ أَبِي هَاشِمٍ عَنْ أَبِي خَدِيجَةَ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» أَعْطُوا مِنَ اَلزَّكَاةِ بَنِي هَاشِمٍ مَنْ أَرَادَهَا مِنْهُمْ فَإِنَّهَا تَحِلُّ لَهُمْ وَإِنَّمَا تَحْرُمُ عَلَى اَلنَّبِيِّ صَلَّى اَللَّهُ عَلَيْهِ وَآلِهِ وَ عَلَى اَلْإِمَامِ اَلَّذِي يَكُونُ بَعْدَهُ وَ عَلَى اَلْأَئِمَّةِ عَلَيْهِمُ اَلسَّلاَمُ«.

As for the report which Ali ibn al-Hasan ibn Faddal narrated from Abd al-Rahman ibn Abi Hashim, from Abu Khadijah, from Abu Abdillah (a.s), peace be upon him, who said: Imam (a.s) said: “Give from zakat to Banu Hashim, whoever among them wants it, for it is lawful for them. It is only forbidden for the Prophet (saws), may Allah (swt) bless him and his family, and for the Imam (a.s) who comes after him, and for the Imams (a.s), peace be upon them.”

Commentary 4

فالاصل في هذا الخبر أبو خديجة وإن تكرر في الكتب ولم يروه غيره، ويحتمل أن يكون أراد عليه السلام حال الضرورة دون حال الاختيار لانا قد بينا ان في حال الضرورة مباح لهم ذلك ويكون وجه اختصاص الائمة عليهم السلام منهم بالذكر في الخبر ان الائمة عليهم السلام لا يضطرون إلى أكل الزكوات والتقوت بها، وغيرهم من بني عبد المطلب قد يضطرون إلى ذلك وأما الخبر الذي رواه:

The basis of this report is Abu Khadijah, even if it is repeated in the books, and no one other than him narrated it. It is possible that the Imam (a.s), peace be upon him, intended the state of necessity, not the state of choice, because we have already clarified that in the state of necessity this is permissible for them. The reason for specifically mentioning the Imams (a.s), peace be upon them, from among them in the report is that the Imams (a.s), peace be upon them, are not compelled to consume zakats and sustain themselves by them, whereas others from Banu Abd al-Muttalib may be compelled to that. As for the report which he narrated (in the following hadith):

Hadith 9

سَعْدُ بْنُ عَبْدِ اَللَّهِ عَنْ أَبِي جَعْفَرٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ بْنِ بَزِيعٍ قَالَ: بَعَثْتُ إِلَى اَلرِّضَا عَلَيْهِ اَلسَّلاَمُ بِدَنَانِيرَ مِنْ قِبَلِ بَعْضِ أَهْلِي وَ كَتَبْتُ إِلَيْهِ أُخْبِرُهُ أَنَّ فِيهَا زَكَاةً خَمْسَةً وَ سَبْعِينَ وَ اَلْبَاقِيَ صِلَةٌ فَكَتَبَ عَلَيْهِ اَلسَّلاَمُ بِخَطِّهِ »قَبَضْتُ وَبَعَثْتُ إِلَيْهِ دَنَانِيرَ لِي وَلِغَيْرِي« وَكَتَبْتُ إِلَيْهِ أَنَّهَا مِنْ فِطْرَةِ اَلْعِيَالِ فَكَتَبَ عَلَيْهِ اَلسَّلاَمُ بِخَطِّهِ» قَبَضْتُ«.

Sa’ad ibn Abdullah, from Abu Jafar, from Muhammad ibn Ismail ibn Bazi, who said: I (narrator) sent dinars to Imam al-Ridha (a.s), peace be upon him, on behalf of some of my family, and I wrote to Imam (a.s) informing him that among them was zakat, seventy-five, and the remainder was a gift. Imam (a.s), peace be upon him, wrote in his own handwriting: “I have received it.” And I (narrator) sent to Imam (a.s) dinars belonging to me and to others, and I wrote to Imam (a.s) that they were from the fitrah of the dependents. Imam (a.s), peace be upon him, wrote in his own handwriting: “I have received it.”

Commentary 5

فليس في هذا الخبر انه قبض ذلك لنفسه أو لغيره، ويحتمل أن يكون ذلك إنما قبض لغيره ممن يستحق ذلك لانهم عليهم السلام كانوا يقبضون الزكوات ويطلبونها ويفرقونها على مواليهم ممن يستحق ذلك والذي يدل على ذلك ما رواه:

There is nothing in this report stating that Imam (a.s) received that (zakat) for himself or for someone else. It is possible that Imam (a.s) only received that for someone else from among those who were entitled to it, as the Imams (a.s), used to receive the zakats, request them, and distribute them among their mawali from among those who were entitled to that. That which indicates this is what he narrated (in the following hadith):

Hadith 10

مُحَمَّدُ بْنُ يَعْقُوبَ عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ مُحَمَّدِ بْنِ اَلْحُسَيْنِ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنْ ثَعْلَبَةَ بْنِ مَيْمُونٍ قَالَ: كَانَ أَبُو عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ يَسْأَلُ شِهَاباً مِنْ زَكَاتِهِ لِمَوَالِيهِ» وَ إِنَّمَا حُرِّمَتِ اَلزَّكَاةُ عَلَيْهِمْ دُونَ مَوَالِيهِمْ«.

Muhammad ibn Yaqub, from Muhammad ibn Yahya, from Muhammad ibn al-Husayn, from Muhammad ibn Ismail, from Thalabah ibn Maymun, who said: Abu Abdillah (a.s), peace be upon him, used to ask Shihab for some of his zakat for his mawali, “and zakat was only forbidden for them (the Imams (a.s)), not for their mawali.”

Commentary 6

والذي يدل على ان صدقة بعضهم على بعض جائزة مضافا إلى ما قدمناه ما رواه:

That which indicates that the charity of some of them (Banu Hashim) to others is permissible, as already presented, is what he narrated (in the following hadith):

Hadith 11

عَلِيُّ بْنُ اَلْحَسَنِ بْنِ فَضَّالٍ عَنْ إِبْرَاهِيمَ بْنِ هَاشِمٍ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ زُرَارَةَ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ: قُلْتُ لَهُ صَدَقَاتُ بَنِي هَاشِمٍ بَعْضِهِمْ عَلَى بَعْضٍ تَحِلُّ لَهُمْ فَقَالَ» نَعَمْ صَدَقَةُ اَلرَّسُولِ صَلَّى اَللَّهُ عَلَيْهِ وَآلِهِ تَحِلُّ لِجَمِيعِ اَلنَّاسِ مِنْ بَنِي هَاشِمٍ وَ غَيْرِهِمْ وَ صَدَقَاتُ بَعْضِهِمْ عَلَى بَعْضٍ تَحِلُّ لَهُمْ وَ لاَ تَحِلُّ لَهُمْ صَدَقَاتُ إِنْسَانٍ غَرِيبٍ«.

Ali ibn al-Hasan ibn Faddal, from Ibrahim ibn Hashim, from Hammad ibn Isa, from Hariz, from Zurarah, from Abu Abdillah (a.s), peace be upon him, who said: I said to Imam (a.s): “The charities of Banu Hashim, of some of them to others among them, are they lawful for them?” Imam (a.s) said: “Yes. The charity of the Messenger (saws), may Allah (swt) bless him and his family, is lawful for all people, from Banu Hashim and others besides them. And the charities of some of them (Banu Hashim) to others among them are lawful for them, but the charities of a stranger (non Banu Hashim) are not lawful for them.”

وأما الذي يدل على ان ما عدا المفروض من الصدقات مباح لهم مضافا إلى ما قدمناه ما رواه:

As for that which indicates that what is other than the obligatory from charities is permissible for them, in addition to what we have already presented, it is what he narrated (in the following hadith):

Hadith 12

سَعْدُ بْنُ عَبْدِ اَللَّهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ اَلْحُسَيْنِ بْنِ سَعِيدٍ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ عَبْدِ اَلرَّحْمَنِ بْنِ اَلْحَجَّاجِ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ أَنَّهُ قَالَ:» لَوْ حُرِّمَتْ عَلَيْنَا اَلصَّدَقَةُ لَمْ يَحِلَّ لَنَا أَنْ نَخْرُجَ إِلَى مَكَّةَ لِأَنَّ كُلَّ مَاءٍ بَيْنَ مَكَّةَ وَ اَلْمَدِينَةِ فَهُوَ صَدَقَةٌ«.

Sa’ad ibn Abdullah, from Ahmad ibn Muhammad, from al-Husayn ibn Said, from Muhammad ibn Abi Umayr, from Abd al-Rahman ibn al-Hajjaj, from Abu Abdillah (a.s), peace be upon him, that he said: Imam (a.s) said: “If charity had been forbidden for us (Banu Hashim), it would not be lawful for us to go out to Mecca, because every water between Mecca and Madinah is charity.”

Hadith 13

مُحَمَّدُ بْنُ يَعْقُوبَ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنِ اَلْفَضْلِ بْنِ شَاذَانَ عَنْ صَفْوَانَ عَنْ عَبْدِ اَلرَّحْمَنِ بْنِ اَلْحَجَّاجِ عَنْ جَعْفَرِ بْنِ إِبْرَاهِيمَ اَلْهَاشِمِيِّ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ: قُلْتُ أَ تَحِلُّ اَلصَّدَقَةُ لِبَنِي هَاشِمٍ فَقَالَ» إِنَّمَا تِلْكَ اَلصَّدَقَةُ اَلْوَاجِبَةُ عَلَى اَلنَّاسِ لاَ تَحِلُّ لَنَا فَأَمَّا غَيْرُ ذَلِكَ فَلَيْسَ بِهِ بَأْسٌ وَ لَوْ كَانَ كَذَلِكَ مَا اِسْتَطَاعُوا أَنْ يَخْرُجُوا إِلَى مَكَّةَ هَذِهِ اَلْمِيَاهُ عَامَّتُهَا صَدَقَةٌ«.

Muhammad ibn Yaqub, from Muhammad ibn Ismail, from al-Fadl ibn Shadhan, from Safwan, from Abd al-Rahman ibn al-Hajjaj, from Jafar ibn Ibrahim al-Hashimi, from Abu Abdillah (a.s), peace be upon him, who said: I (narrator) said: “Is charity lawful for Banu Hashim?” Imam (a.s) said: “That is only the obligatory charity upon the people; it is not lawful for us (Banu Hashim). As for other than that, there is no harm in it. And if it were like that, they (Banu Hashim) would not be able to go out to Mecca; these waters, most of them, are charity.”
