Book 2, Chapter 119

Loan That Brings Profit
4 Aḥadīth

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ أَبِي أَيُّوبَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ وَغَيْرِهِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (a.s) عَنِ الرَّجُلِ يَسْتَقْرِضُ مِنَ الرَّجُلِ قَرْضاً وَيُعْطِيهِ الرَّهْنَ إِمَّا خَادِماً وَإِمَّا آنِيَةً وَإِمَّا ثِيَاباً فَيَحْتَاجُ إِلَى شَيْ‏ءٍ مِنْ مَنْفَعَتِهِ فَيَسْتَأْذِنُهُ فِيهِ فَيَأْذَنُ لَهُ قَالَ إِذَا طَابَتْ نَفْسُهُ فَلا بَأْسَ قُلْتُ إِنَّ مَنْ عِنْدَنَا يَرْوُونَ أَنَّ كُلَّ قَرْضٍ يَجُرُّ مَنْفَعَةً فَهُوَ فَاسِدٌ فَقَالَ أَوَلَيْسَ خَيْرُ الْقَرْضِ مَا جَرَّ مَنْفَعَةً.


1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from abu Ayyub from Muhammad ibn Muslim and others who has said the following: “This is concerning my question before abu ‘ Abd Allah (a.s), about the case of a man who asked for a loan. He left al-Rahn (security deposit) like a servant or utensils or cloths. The party needed to benefit from them, so he asked permission and he gave permission. He (the Imam) said, if permission is given without compulsion it is not unlawful/ I then said, in our area people see it as if every loan brings benefits. Is it invalid?’ He (the Imam) said, is it not a fact that the best loans are those which attract benefits?’”

2- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ صَفْوَانَ عَنِ ابْنِ بُكَيْرٍ عَنْ مُحَمَّدِ بْنِ عَبْدَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (a.s) عَنِ الْقَرْضِ يَجُرُّ الْمَنْفَعَةَ فَقَالَ خَيْرُ الْقَرْضِ الَّذِي يَجُرُّ الْمَنْفَعَةَ.


2. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan from ibn Bukayr from Muhammad ibn ‘Abdah who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s), if loan attracted benefits. He (the Imam) said, ‘The best loan is that which attracts benefits.’”

3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ بِشْرِ بْنِ مَسْلَمَةَ وَغَيْرِ وَاحِدٍ عَمَّنْ أَخْبَرَهُمْ عَنْ أَبِي جَعْفَرٍ (a.s) قَالَ خَيْرُ الْقَرْضِ مَا جَرَّ مَنْفَعَةً.


3. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Bishr ibn Muslimah from more than one person who reported who has said the following: “Abu Ja‘far (a.s), has said, ‘The best loan is that which attracts benefits.’”

4- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَجَّاجِ قَالَ سَأَلْتُ أَبَا الْحَسَنِ (a.s) عَنِ الرَّجُلِ يَجِيئُنِي فَأَشْتَرِي لَهُ الْمَتَاعَ مِنَ النَّاسِ وَأَضْمَنُ عَنْهُ ثُمَّ يَجِيئُنِي بِالدَّرَاهِمِ فَ‏آخُذُهَا وَأَحْبِسُهَا عَنْ صَاحِبِهَا وَآخُذُ الدَّرَاهِمَ الْجِيَادَ وَأُعْطِي دُونَهَا فَقَالَ إِذَا كَانَ يَضْمَنُ فَرُبَّمَا اشْتَدَّ عَلَيْهِ فَعَجَّلَ قَبْلَ أَنْ يَأْخُذَهُ وَيَحْبِسُ بَعْدَ مَا يَأْخُذُ فَلا بَأْسَ.


4. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from ‘Abd al-Rahman ibn al-Hajjaj who has said the following: “I once asked abu al-Hassan (a.s), about the case of a man who came to me; I bought for him goods from people and guaranteed payment on his behalf. Then he came to me with dirham. I took and withheld them from their owner, then took the good quality dirhams and gave them of lower quality. He (the Imam) said, ‘He guaranteed payment, perhaps it became severe upon him so he hurried to pay before he (the guarantor) asks for payment. He (the guarantor) withholds payment after receiving, it is not unlawful.’”
