Chapter on Ruling of Vegetables in Zakat

قال الشيخ رحمه الله:) ولا خلاف بين آل الرسول وبين شيعتهم من أهل الامامة ان الخضر كالقصب والبطيخ وما اشبهه مما لا بقاء له لا زكاة فيه ولا زكاة على ثمنه حتى يحول عليه الحول وهو بحاله(. يدل على ذلك ما رواه:

The Shaykh (Al-Mufid), may Allah (swt) have mercy on him, said: “There is no disagreement between the Family of the Messenger (saws) and their Shia from the people of the Imamate that green produce, such as reeds (qasab), melons, and whatever resembles them from that which has no lasting preservation, has no zakat upon it. And there is no zakat upon its price until a year passes over it while it remains in its state.” That which indicates this is what he narrated (in the following hadith):

Hadith 1

مُحَمَّدُ بْنُ عَلِيِّ بْنِ مَحْبُوبٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ اَلْحُسَيْنِ عَنِ اَلْقَاسِمِ عَنْ عَلِيٍّ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» لَيْسَ عَلَى اَلْخُضَرِ وَ لاَ عَلَى اَلْبِطِّيخِ وَ لاَ عَلَى اَلْبُقُولِ وَأَشْبَاهِهِ زَكَاةٌ إِلاَّ مَا اِجْتَمَعَ عِنْدَكَ مِنْ غَلَّتِهِ فَبَقِيَ عِنْدَكَ سَنَةً«.

Muhammad ibn Ali ibn Mahbub, from Ahmad ibn Muhammad, from al-Husayn, from al-Qasim, from Ali, from Abu Basir, from Abu Abdillah (a.s), peace be upon him, who said: Imam (a.s) said: “There is no zakat upon vegetables, nor upon melons, nor upon herbs and their like, except what has gathered with you from its yield and remains with you for a year.”

Hadith 2

وَ عَنْهُ عَنِ اَلْعَبَّاسِ بْنِ مَعْرُوفٍ عَنْ حَمَّادٍ عَنْ حَرِيزٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ وَ أَبِي عَبْدِ اَللَّهِ عَلَيْهِمَا اَلسَّلاَمُ أَنَّهُمَا قَالاَ:» عَفَا رَسُولُ اَللَّهِ صَلَّى اَللَّهُ عَلَيْهِ وَآلِهِ عَنِ اَلْخُضَرِ« قُلْتُ وَ مَا اَلْخُضَرُ قَالاَ» كُلُّ شَيْءٍ لاَ يَكُونُ لَهُ بَقَاءٌ اَلْبَقْلُ وَ اَلْبِطِّيخُ وَاَلْفَوَاكِهُ وَشِبْهُ ذَلِكَ مِمَّا يَكُونُ سَرِيعَ اَلْفَسَادِ« قَالَ زُرَارَةُ قُلْتُ لِأَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ هَلْ فِي اَلْقَصَبِ شَيْءٌ قَالَ» لاَ«.

And from him, from al-Abbas ibn Maruf, from Hammad, from Hariz, from Zurarah, from Abu Ja’far (a.s) and Abu Abdillah (a.s), peace be upon them both, said: Imam (a.s) said: “The Messenger of Allah (swt), may Allah (swt) bless him and his family, exempted vegetables.” I (narrator) asked: “And what are vegetables?” The both Imams (a.s) said: “Everything that does not have permanence: herbs, melons, fruits, and the like of that from what spoils quickly.” Zurarah said: “I said to Abu Abdillah (a.s), peace be upon him: ‘Is there anything due on reeds?’” Imam (a.s) said: “No.”

Hadith 3

مُحَمَّدُ بْنُ يَعْقُوبَ عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ مُحَمَّدِ بْنِ اَلْحُسَيْنِ عَنْ صَفْوَانَ عَنِ اَلْعَلاَءِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ: أَنَّهُ سُئِلَ عَنِ اَلْخُضَرِ فِيهَا زَكَاةٌ وَ إِنْ بِيعَ بِالْمَالِ اَلْعَظِيمِ فَقَالَ» لاَ حَتَّى يَحُولَ عَلَيْهِ اَلْحَوْلُ«.

Muhammad ibn Yaqub, from Muhammad ibn Yahya, from Muhammad ibn al-Husayn, from Safwan, from al-Ala, from Muhammad ibn Muslim, from Abu Ja’far (a.s), peace be upon him: Imam (a.s) was asked about ‘vegetables, Is there zakat in them, even if they are sold for a great amount of wealth?’ Imam (a.s) said: “No, until a year passes over it.”

Hadith 4

وَ عَنْهُ عَنْ عَلِيٍّ عَنْ أَبِيهِ عَنِ اِبْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ اَلْحَلَبِيِّ قَالَ: قُلْتُ لِأَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ مَا فِي اَلْخُضْرَةِ قَالَ» وَ مَا هِيَ« قُلْتُ اَلْقَصَبُ وَ اَلْبِطِّيخُ وَ مِثْلُهُ مِنَ اَلْخُضَرِ فَقَالَ» لاَ شَيْءَ عَلَيْهِ إِلاَّ أَنْ يُبَاعَ مِثْلُهُ بِمَالٍ فَيَحُولَ عَلَيْهِ اَلْحَوْلُ فَفِيهِ اَلصَّدَقَةُ« وَ عَنْ شَجَرِ اَلْغَضَاةِ مِنَ اَلْخَوْخِ وَاَلْفِرْسِكِ وَأَشْبَاهِهِ فِيهِ زَكَاةٌ قَالَ» لاَ« قُلْتُ قِيمَتُهُ قَالَ» مَا حَالَ عَلَيْهِ اَلْحَوْلُ مِنْ ثَمَنِهِ فَزَكِّهِ«.

And from him, from Ali, from his father, from Ibn Abi Umayr, from Hammad, from al-Halabi, who said: I (narrator) said to Abu Abdillah (a.s), peace be upon him: “What is due on greenery?” Imam (a.s) said: “And what is it?” I (narrator) said: “Reeds, melons, and the like of it from vegetables.” Imam (a.s) said: “There is nothing upon it, unless its like is sold for wealth, and a year passes over it; then charity is due in it.” (The narrator asked) “And regarding the trees of al-ghadah, of peaches, nectarines (al-firsik), and their like. ‘Is there zakat in it?’ Imam (a.s) said: “No.” I (narrator) asked: “Its value?” – meaning the value gained from selling such. Imam (a.s) said: “Whatever a year passes over from its price, then give zakat on it.”
