Chapter on the Ruling Concerning Horses in Zakat

قال الشيخ رحمه الله:) وتزكى الخيل الاناث العتاق السائمة والبراذين الاناث السائمة سنة غير فريضة(

The Shaykh (Al-Mufid), may Allah (swt) have mercy on him, said: “Zakat is given on female noble-bred horses (al-khayl al-inath al-itaq) that graze freely (al-saimah), And on female grazing packhorses (al-baradhin al-inath al-saimah), as a Sunnah, not an obligation.”

Hadith 1

مُحَمَّدُ بْنُ يَعْقُوبَ عَنْ عَلِيِّ بْنِ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادٍ عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ وَ زُرَارَةَ عَنْهُمَا جَمِيعاً عَلَيْمَا اَلسَّلاَمُ قَالاَ:» وَضَعَ أَمِيرُ اَلْمُؤْمِنِينَ عَلَيْهِ اَلسَّلاَمُ عَلَى اَلْخَيْلِ اَلْعِتَاقِ اَلرَّاعِيَةِ فِي كُلِّ فَرَسٍ فِي كُلِّ عَامٍ دِينَارَيْنِ وَ جَعَلَ عَلَى اَلْبَرَاذِينِ دِينَاراً«.

Muhammad ibn Yaqub, from Ali ibn Ibrahim, from his father, from Hammad, from Hariz, from Muhammad ibn Muslim and Zurarah, from both of Abu Ja’far (a.s) and Abu Abdillah (a.s), peace be upon them both, said: The Imams (a.s) said: “The Commander of the Faithful (a.s), peace be upon him, placed upon noble grazing horses, for every horse in every year, two dinars, And the Imam (a.s) placed upon draft horses one dinar.”

Hadith 2

حَمَّادٌ عَنْ حَرِيزٍ عَنْ زُرَارَةَ قَالَ: قُلْتُ لِأَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ هَلْ عَلَى اَلْبِغَالِ شَيْءٌ فَقَالَ» لاَ« فَقُلْتُ كَيْفَ صَارَ عَلَى اَلْخَيْلِ وَ لَمْ يَصِرْ عَلَى اَلْبِغَالِ فَقَالَ» لِأَنَّ اَلْبِغَالَ لاَ تَلْقَحُ وَ اَلْخَيْلُ اَلْإِنَاثُ يُنْتِجْنَ وَ لَيْسَ عَلَى اَلْخَيْلِ اَلذُّكُورِ شَيْءٌ« قَالَ قُلْتُ هَلْ عَلَى اَلْفَرَسِ أَوِ اَلْبَعِيرِ يَكُونُ لِلرَّجُلِ يَرْكَبُهَا شَيْءٌ فَقَالَ» لاَ لَيْسَ عَلَى مَا يُعْلَفُ شَيْءٌ إِنَّمَا اَلصَّدَقَةُ عَلَى اَلسَّائِمَةِ اَلْمُرْسَلَةِ فِي مَرْجِهَا عَامَهَا اَلَّذِي يَقْتَنِيهَا فِيهِ اَلرَّجُلُ فَأَمَّا مَا سِوَى ذَلِكَ فَلَيْسَ فِيهِ شَيْءٌ«.

Hammad, from Hariz, from Zurarah, who said: I (narrator) said to Abu Abdillah (a.s), peace be upon him: “Is there anything due upon mules?” Imam (a.s) said: “No.” So I (narrator) asked: “How has it become due upon horses but not become due upon mules?” Imam (a.s) said: “Because mules do not conceive, while female horses give birth, and there is nothing due upon male horses.” He (narrator) said: “I asked: ‘Is there anything due upon a horse or a camel which belongs to a man and which he rides?’” Imam (a.s) said: “No. There is nothing due upon that which is fed with fodder. Charity is only upon freely grazing livestock (al-saimah), released in its pasture during the year in which the man keeps it. As for other than that, there is nothing due in it.”
