عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَحَدِهِمَا ( عليهما السلام ) فِي الرَّجُلِ يُطَلِّقُ الصَّبِيَّةَ الَّتِي لَمْ تَبْلُغْ وَ لَا تَحْمِلُ مِثْلُهَا وَ قَدْ كَانَ دَخَلَ بِهَا وَ الْمَرْأَةَ الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ وَ ارْتَفَعَ حَيْضُهَا فَلَا تَلِدُ مِثْلُهَا قَالَ لَيْسَ عَلَيْهِمَا عِدَّةٌ وَ إِنْ دَخَلَ بِهِمَا .مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ حَدِيدٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ بَعْضِ أَصْحَابِنَا مِثْلَهُ .

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Jamil ibn Darraj from certain persons of our people who has said the following: “There is the case of a man who divorces a girl who is not mature yet and the like of whom cannot become pregnant, but he has gone to bed with her and a woman after menopause when women of her condition cannot give birth. One of the two Imam, (abu Ja‘far or abu ‘ Abd Allah), ‘Alayhim al-Salam, has said, ‘There is no waiting period for them.’” Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn Hadid from Jamil ibn Darraj from certain persons of our people a similar Hadith. 

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ مَحْبُوبٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَمَّنْ رَوَاهُ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) فِي الصَّبِيَّةِ الَّتِي لَا تَحِيضُ مِثْلُهَا وَ الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ قَالَ لَيْسَ عَلَيْهِمَا عِدَّةٌ وَ إِنْ دُخِلَ بِهِمَا .

2. Ali ibn Ibrahim has narrated from his father from ibn Mahbub from Hammad ibn ‘Uthman from the one who narrated to him who has said the following: “About the case of a girl whose likes do not experience Hayd (menses) and a woman after menopause abu ‘Abd Allah (a.s.), has said, ‘They do not need to count waiting period even if he has gone to bed with them.”’ 

أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ وَ الرَّزَّازُ عَنْ أَيُّوبَ بْنِ نُوحٍ وَ حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ جَمِيعاً عَنْ صَفْوَانَ عَنْ مُحَمَّدِ بْنِ حَكِيمٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ الَّتِي لَا تَحْبَلُ مِثْلُهَا لَا عِدَّةَ عَلَيْهَا .

3. Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and al-Razzaz from Ayyub ibn Nuh and Humayd ibn Ziyad from ibn Sama‘ah all from Safwan from Muhammad ibn Hakim from Muhammad ibn Muslim who has said the following: “Abu Ja‘far (a.s.), has said, ‘A woman the like of whom cannot become pregnant does not need to count a waiting period.’” 

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ أَبِي نَجْرَانَ عَنْ صَفْوَانَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَجَّاجِ قَالَ قَالَ أَبُو عَبْدِ اللَّهِ ( عليه السلام ) ثَلَاثٌ يَتَزَوَّجْنَ عَلَى كُلِّ حَالٍ الَّتِي لَمْ تَحِضْ وَ مِثْلُهَا لَا تَحِيضُ قَالَ قُلْتُ وَ مَا حَدُّهَا قَالَ إِذَا أَتَى لَهَا أَقَلُّ مِنْ تِسْعِ سِنِينَ وَ الَّتِي لَمْ يُدْخَلْ بِهَا وَ الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ وَ مِثْلُهَا لَا تَحِيضُ قُلْتُ وَ مَا حَدُّهَا قَالَ إِذَا كَانَ لَهَا خَمْسُونَ سَنَةً .

4. A number of our people have narrated from Sahl ibn Ziyad from ibn abu Najran from Safwan from ‘Abd al-Rahman ibn al-Hajj aj who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Three kinds of women can marry in all conditions: a woman who does not experience Hayd (menses) and alike whom women do not experience Hayd (menses).’ He (the narrator) has said that I then asked, ‘What is her limit?’ He (the Imam) said, ‘One who is less than nine years, one with whom he has not gone to bed and one after menopause and whose like do not experience Hayd (menses).’ I then asked, ‘What is the limit?’ He (the Imam) said, ‘It is when she becomes fifty years old.’” 

بَعْضُ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ صَفْوَانَ عَنْ مُحَمَّدِ بْنِ حَكِيمٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَمِعْتُ أَبَا جَعْفَرٍ ( عليه السلام ) يَقُولُ فِي الْمَرْأَةِ الَّتِي قَدْ يَئِسَتْ مِنَ الْمَحِيضِ قَالَ بَانَتْ مِنْهُ وَ لَا عِدَّةَ عَلَيْهَا .وَ قَدْ رُوِيَ أَيْضاً أَنَّ عَلَيْهِنَّ الْعِدَّةَ إِذَا دُخِلَ بِهِنَّ .

5. Certain persons of our people have narrated from Ahmad ibn Muhammad, from Safwan from Muhammad ibn Hakim from Muhammad ibn Muslim who has said the following: “I once heard abu Ja‘far (a.s.), saying, ‘A woman after menopause if divorced becomes stranger to him and she does not need to count a waiting period.’” It is also narrated that if sexual intercourse has taken place with them there is a waiting period for them. 

حميد بن زياد، عن ابن سماعة، عن عبد الله بن جبلة، عن علي بن أبي حمزة، عن أبي بصير قال: عدة التي لم تبلغ المحيض ثلاثة أشهر، والتي قد قعدت من المحيض ثلاثة أشهر، وكان ابن سماعة يأخذ بها ويقول: إن ذلك في الإماء لا يستبرئن إذا لم يكن بلغن المحيض فأما الحرائر فحكمهن في القرآن يقول الله عز وجل: " واللائي يئسن من المحيض من نسائكم إن ارتبتم فعدتهن ثلاثة أشهر واللائي لم يحضن " وكان معاوية بن حكيم يقول: ليس عليهن عدة وما احتج به ابن سماعة فإنما قال الله عز وجل: " إن ارتبتم " وإنما ذلك إذا وقعت الريبة بأن قد يئسن أو لم يئسن فأما إذا جازت الحد وارتفع الشك بأنها قد يئست أو لم تكن الجارية بلغت الحد فليس عليهن عدة.

6. Humayd ibn Ziyad has narrated from ibn Sama‘ah from ‘Abd Allah ibn Jabalah from Ali ibn abu Hamzah from abu Basir who has said the following: “Waiting period of those who do not experience Hayd (menses) and after menopause is three months and ibn Sama‘ah would follow it. He would say it is about slave-girls. They do not need Istibra’ (quarantine) if they have not become mature. The rules for free women are in the Quran as Allah, most Majestic, most Glorious, says, "... after menopause if you have doubts their waiting period is three months and those who do not experience Hayd (menses).’ Mu’awiyah ibn Hukaym would say, ‘They do not need to count waiting period and ibn Sama‘ah’s argument is based on ‘if you doubt ’ which is only when there is doubt about menopause. When she passes this limit and doubt is removed and that the girl has not reached the limit then waiting period does not apply to their case.’”
