79. Marriage with a Woman Divorced Against the Sunnah

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ إِيَّاكُمْ وَذَوَاتِ الأزْوَاجِ الْمُطَلَّقَاتِ عَلَى غَيْرِ السُّنَّةِ قَالَ قُلْتُ لَهُ فَرَجُلٌ طَلَّقَ امْرَأَتَهُ مِنْ هَؤُلاءِ وَلِي بِهَا حَاجَةٌ قَالَ فَتَلْقَاهُ بَعْدَ مَا طَلَّقَهَا وَانْقَضَتْ عِدَّتُهَا عِنْدَ صَاحِبِهَا فَتَقُولُ لَهُ طَلَّقْتَ فُلانَةَ فَإِذَا قَالَ نَعَمْ فَقَدْ صَارَ تَطْلِيقَةً عَلَى طُهْرٍ فَدَعْهَا مِنْ حِينَ طَلَّقَهَا تِلْكَ التَّطْلِيقَةَ حَتَّى تَنْقَضِيَ عِدَّتُهَا ثُمَّ تَزَوَّجْهَا فَقَدْ صَارَتْ تَطْلِيقَةً بَائِنَةً.


1. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from ‘Uthman ibn ‘Isa from certain persons of our people who have said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘You must remain on your guard in the case of married women who are divorced against the Sunnah.’ I asked him (the Imam) that a man has divorced his wife and I am interested. He (the Imam) said, ‘Meet him after he divorces her and waiting period is complete with him then ask him, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her’, this is one divorce during a menses free period. From the time he has divorced her until waiting period is complete then you can marry and divorce has made them complete strangers to each other.’”

2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنِ النَّضْرِ بْنِ سُوَيْدٍ عَنْ مُحَمَّدِ بْنِ أَبِي حَمْزَةَ عَنْ شُعَيْبٍ الْحَدَّادِ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) رَجُلٌ مِنْ مَوَالِيكَ يُقْرِئُكَ السَّلامَ وَقَدْ أَرَادَ أَنْ يَتَزَوَّجَ امْرَأَةً قَدْ وَافَقَتْهُ وَأَعْجَبَهُ بَعْضُ شَأْنِهَا وَقَدْ كَانَ لَهَا زَوْجٌ فَطَلَّقَهَا ثَلاثاً عَلَى غَيْرِ السُّنَّةِ وَقَدْ كَرِهَ أَنْ يُقْدِمَ عَلَى تَزْوِيجِهَا حَتَّى يَسْتَأْمِرَكَ فَتَكُونَ أَنْتَ تَأْمُرُهُ فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) هُوَ الْفَرْجُ وَأَمْرُ الْفَرْجِ شَدِيدٌ وَمِنْهُ يَكُونُ الْوَلَدُ وَنَحْنُ نَحْتَاطُ فَلا يَتَزَوَّجْهَا.


2. A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from Muhammad ibn abu Hamzah from Shu’ayb al-Hadad who has said the following: “I once said to abu ‘Abd Allah, ‘Alayhi al-Salam, ‘One of your followers offers greetings of peace to you and he wants to marry a woman who has agreed and he likes her due to certain matters about her and she has a husband who has divorced her three times on non-Sunnah basis. He dislikes marrying her without your instruction so you command him to do so. Abu ‘Abd Allah, ‘Alayhi al-Salam, said, ‘It is an issue of marriage and the matter of marriage is severe because from marriage are children and we maintain precaution, so he must not marry her.’”

3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَفْصِ بْنِ الْبَخْتَرِيِّ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثاً فَأَرَادَ رَجُلٌ أَنْ يَتَزَوَّجَهَا كَيْفَ يَصْنَعُ قَالَ يَدَعُهَا حَتَّى تَحِيضَ وَتَطْهُرَ ثُمَّ يَأْتِيهِ وَمَعَهُ رَجُلانِ شَاهِدَانِ فَيَقُولُ أَطَلَّقْتَ فُلانَةَ فَإِذَا قَالَ نَعَمْ تَرَكَهَا ثَلاثَةَ أَشْهُرٍ ثُمَّ خَطَبَهَا إِلَى نَفْسِهَا.


3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hafs ibn al-Bakhtariy from Ishaq ibn ‘Ammar who has said the following: “About the case of a man who divorces his wife three times and then another man wants to marry her and about what he must do, abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘He must wait until she experiences one cycle of menses; then he must go to the man who has divorced her and ask him in the presence of two people, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her, then he must leave her alone for three months, then propose to her for marriage.’”

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُوسَى بْنِ بَكْرٍ عَنْ عَلِيِّ بْنِ حَنْظَلَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ إِيَّاكَ وَالْمُطَلَّقَاتِ ثَلاثاً فِي مَجْلِسٍ فَإِنَّهُنَّ ذَوَاتُ أَزْوَاجٍ.


4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Ali ibn Hanzalah who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Beware of the case of a woman divorced three times in one meeting; they are married women.”
