قال الشيخ رحمه الله:) والخمس واجب في كل مغنم ثم قال: والغنائم كل ما استفيد بالحرب من الاموال والسلاح والاثواب والرقيق وما استفيد من المعادن والغوص والكنوز والعنبر وكل ما فضل من ارباح التجارات والزراعات والصناعات من المؤنة والكفاية في طول السنة على الاقتصاد(

The Shaykh (Al-Mufid), may Allah (swt) have mercy upon him, said: “The one-fifth levy (khums) is obligatory in every gain (maghnam).” Then he said: “The spoils (al-ghanaim) are everything acquired through war, from wealth, weapons, garments, and slaves; and what is acquired from mines, diving, treasures, and ambergris (anbar); And everything that remains surplus from the profits of trade, agriculture, and crafts after expenses and sufficiency throughout the year with moderation.”

Hadith 1

عَلِيُّ بْنُ اَلْحَسَنِ بْنِ فَضَّالٍ عَنِ اَلْحَسَنِ بْنِ عَلِيِّ بْنِ يُوسُفَ عَنْ مُحَمَّدِ بْنِ سِنَانٍ عَنْ عَبْدِ اَلصَّمَدِ بْنِ بَشِيرٍ عَنْ حُكَيْمٍ مُؤَذِّنِ بَنِي عَبْسٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ: قُلْتُ لَهُ» وَاِعْلَمُوا أَنَّمٰا غَنِمْتُمْ مِنْ شَيْءٍ فَأَنَّ لِلّٰهِ خُمُسَهُ وَ لِلرَّسُولِ« قَالَ» هِيَ وَ اَللَّهِ اَلْإِفَادَةُ يَوْماً بِيَوْمٍ إِلاَّ أَنَّ أَبِي عَلَيْهِ اَلسَّلاَمُ جَعَلَ شِيعَتَنَا مِنْ ذَلِكَ فِي حِلٍّ لِيَزْكُوا«.

Ali ibn al-Hasan ibn Faddal, from al-Hasan ibn Ali ibn Yusuf, from Muhammad ibn Sinan, from Abd al-Samad ibn Bashir, from Hukaym, the mu'adhdhin of Banu Abs, from Abu Abdillah (a.s), peace be upon him, who said: I (narrator) said to Imam (a.s): "And know that whatever thing you gain, then indeed for Allah (swt) is its fifth, and for the Messenger (saws)." (Surah Al-Anfal 8:41) Imam (a.s) said: "It is, by Allah (swt), the gain day by day, except that my father (a.s), peace be upon him, made our Shia free of liability from that, so that they may become pure."

Hadith 2

عَلِيُّ بْنُ مَهْزِيَارَ عَنْ فَضَالَةَ وَاِبْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ قَالَ: سَأَلْتُهُ عَنْ مَعَادِنِ اَلذَّهَبِ وَ اَلْفِضَّةِ وَاَلصُّفْرِ وَاَلْحَدِيدِ وَ اَلرَّصَاصِ فَقَالَ» عَلَيْهَا اَلْخُمُسُ جَمِيعاً«.

Ali ibn Mahziyar, from Fadalah and Ibn Abi Umayr, from Jamil, from Muhammad ibn Muslim, from Abu Ja’far (a.s), peace be upon him, who said: I (narrator) asked Imam (a.s) about ‘mines of gold, silver, brass (sufr), iron, and lead.’ Imam (a.s) said: "Upon all of them is the fifth (khums)."

Hadith 3

وَ عَنْهُ عَنِ اِبْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ اَلْحَلَبِيِّ قَالَ: سَأَلْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنِ اَلْعَنْبَرِ وَغَوْصِ اَللُّؤْلُؤِ فَقَالَ» عَلَيْهِ اَلْخُمُسُ« قَالَ وَ سَأَلْتُهُ عَنِ اَلْكَنْزِ كَمْ فِيهِ قَالَ» اَلْخُمُسُ« وَ عَنِ اَلْمَعَادِنِ كَمْ فِيهَا قَالَ» اَلْخُمُسُ« وَ عَنِ اَلرَّصَاصِ وَاَلصُّفْرِ وَاَلْحَدِيدِ وَمَا كَانَ بِالْمَعَادِنِ كَمْ فِيهَا قَالَ» يُؤْخَذُ مِنْهَا كَمَا يُؤْخَذُ مِنْ مَعَادِنِ اَلذَّهَبِ وَاَلْفِضَّةِ«.

And from him, from Ibn Abi Umayr, from Hammad, from al-Halabi, who said: I (narrator) asked Abu Abdillah (a.s), peace be upon him, about ‘ambergris and diving for pearls.’ Imam (a.s) said: "Upon it is the fifth." He (narrator) said: “And I asked Imam (a.s) about ‘treasure, how much is in it?’” – meaning khums. Imam (a.s) said: "The fifth." And (Imam (a.s) was asked) about ‘mines, how much is in them?’ Imam (a.s) said: "The fifth." And (Imam (a.s) was asked) about ‘lead, brass (sufr), iron, and whatever is in the mines, how much is in them?’ Imam (a.s) said: "It is taken from them just as it is taken from the mines of gold and silver."

Hadith 4

مُحَمَّدُ بْنُ عَلِيِّ بْنِ مَحْبُوبٍ عَنِ اَلْعَبَّاسِ بْنِ مَعْرُوفٍ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ قَالَ: سَأَلْتُهُ عَنِ اَلْمَعَادِنِ مَا فِيهَا فَقَالَ »كُلُّمَا كَانَ رِكَازاً فَفِيهِ اَلْخُمُسُ« وَ قَالَ »مَا عَالَجْتَهُ بِمَالِكَ فَفِيهِ مِمَّا أَخْرَجَ اَللَّهُ مِنْهُ مِنْ حِجَارَتِهِ مُصَفًّى اَلْخُمُسُ«.

Muhammad ibn Ali ibn Mahbub, from al-Abbas ibn Ma'ruf, from Hammad ibn Isa, from Hariz, from Zurarah, from Abu Ja’far (a.s), peace be upon him, who said: I (narrator) asked Imam (a.s) about ‘mines, what is in them?’ – meaning khums. Imam (a.s) said: "Everything that is rikaz (precious items buried inside the ground), then in it is the fifth (for khums)." And Imam (a.s) said: "Whatever you process with your wealth, then in what Allah (swt) brings out from it, from its stones, purified, there is the fifth (for khums)."

Hadith 5

وَعَنْهُ عَنْ مُحَمَّدِ بْنِ اَلْحُسَيْنِ عَنْ عَبْدِ اَللَّهِ بْنِ اَلْقَاسِمِ اَلْحَضْرَمِيِّ عَنْ عَبْدِ اَللَّهِ بْنِ سِنَانٍ قَالَ قَالَ أَبُو عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ:» عَلَى كُلِّ اِمْرِئٍ غَنِمَ أَوِ اِكْتَسَبَ اَلْخُمُسُ مِمَّا أَصَابَ لِفَاطِمَةَ عَلَيْهَا اَلسَّلاَمُ وَ لِمَنْ يَلِي أَمْرَهَا مِنْ بَعْدِهَا مِنْ ذُرِّيَّتِهَا اَلْحُجَجِ عَلَى اَلنَّاسِ فَذَاكَ لَهُمْ خَاصَّةً يَضَعُونَهُ حَيْثُ شَاءُوا إِذْ حَرُمَ عَلَيْهِمُ اَلصَّدَقَةُ حَتَّى اَلْخَيَّاطُ لَيَخِيطُ قَمِيصاً بِخَمْسَةِ دَوَانِيقَ فَلَنَا مِنْهَا دَانِقٌ إِلاَّ مَنْ أَحْلَلْنَا مِنْ شِيعَتِنَا لِتَطِيبَ لَهُمْ بِهِ اَلْوِلاَدَةُ إِنَّهُ لَيْسَ مِنْ شَيْءٍ عِنْدَ اَللَّهِ يَوْمَ اَلْقِيَامَةِ أَعْظَمَ مِنَ اَلزِّنَا إِنَّهُ لَيَقُومُ صَاحِبُ اَلْخُمُسِ فَيَقُولُ يَا رَبِّ سَلْ هَؤُلاَءِ بِمَا أُبِيحُوا«.

And from Muhammad ibn al-Husayn, from Abdullah ibn al-Qasim al-Hadrami, from Abdullah ibn Sinan: Abu Abdillah (a.s), peace be upon him, said: “Upon every person who gains or earns is the fifth (khums) from what he acquires, for Sayyidah Fatimah (s.a), peace be upon her, and for whoever undertakes her affair after Her (s.a) from Her (s.a) progeny, the proofs over the people (Ahlul Bayt (a.s)). That (khums) is especially for them; they place it wherever they wish, for charity has been forbidden to them (Ahlul Bayt (a.s)). Even the tailor who sews a shirt for five daniqs (dawaniq), then for us (Ahlul Bayt (a.s)) from it is one daniq, except for those among our Shia for whom we have made it lawful, so that their birth may be pure through it (receiving khums). Indeed, there is nothing greater with Allah (swt) on the Day of Resurrection than fornication. Indeed, the possessor of the fifth (khums) will stand and say: ‘O Lord (azj), ask these people about what was made permissible for them.’”

Hadith 6

أَحْمَدُ بْنُ مُحَمَّدٍ عَنِ اَلْحَسَنِ بْنِ مَحْبُوبٍ عَنْ أَبِي أَيُّوبَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ عَنِ اَلْمَلاَّحَةِ فَقَالَ» وَ مَا اَلْمَلاَّحَةُ« فَقَالَ أَرْضٌ سَبِخَةٌ مَالِحَةٌ يَجْتَمِعُ فِيهَا اَلْمَاءُ فَيَصِيرُ مِلْحاً فَقَالَ» هَذَا اَلْمَعْدِنُ فِيهِ اَلْخُمُسُ« فَقُلْتُ وَاَلْكِبْرِيتُ وَاَلنِّفْطُ يُخْرَجُ مِنَ اَلْأَرْضِ قَالَ فَقَالَ» هَذَا وَأَشْبَاهُهُ فِيهِ اَلْخُمُسُ«.

Ahmad ibn Muhammad, from al-Hasan ibn Mahbub, from Abu Ayyub, from Muhammad ibn Muslim: I (narrator) asked Abu Ja’far (a.s), peace be upon him, about ‘the salt-marsh (mallahah).’ Imam (a.s) said: "And what is the salt-marsh?" So he (narrator) said: “It is barren saline land (ard sabikha) and salty, in which water gathers and then becomes salt.” Imam (a.s) said: "This is a mineral (ma'din); in it is the fifth (khums)." So I (narrator) asked: “And sulphur and oil which are extracted from the earth?” He (narrator) said: “Imam (a.s) said, ‘This and its likes, in them is the fifth (khums).’"

Hadith 7

وَعَنْهُ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ اَلْحُسَيْنِ بْنِ سَعِيدٍ عَنِ اِبْنِ أَبِي عُمَيْرٍ عَنْ حَفْصِ بْنِ اَلْبَخْتَرِيِّ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» خُذْ مَالَ اَلنَّاصِبِ حَيْثُ مَا وَجَدْتَهُ وَ اِدْفَعْ إِلَيْنَا اَلْخُمُسَ

And from him, from Ahmad ibn Muhammad, from al-Husayn ibn Sa'id, from Ibn Abi Umayr, from Hafs ibn al-Bakhtari, from Abu Abdillah (a.s), peace be upon him, who said: Imam (a.s) said: "Take the wealth of the ‘hostile opponent’ (nasibi) wherever you find it, and give the fifth (khums) to us (Ahlul Bayt (a.s))."

Hadith 8

اَلْحُسَيْنُ بْنُ سَعِيدٍ عَنِ اِبْنِ أَبِي عُمَيْرٍ عَنْ سَيْفِ بْنِ عَمِيرَةَ عَنْ أَبِي بَكْرٍ اَلْحَضْرَمِيِّ عَنِ اَلْمُعَلَّى قَالَ:» خُذْ مَالَ اَلنَّاصِبِ حَيْثُ مَا وَجَدْتَهُ وَاِبْعَثْ إِلَيْنَا بِالْخُمُسِ«.

Al-Husayn ibn Sa'id, from Ibn Abi Umayr, from Sayf ibn Amirah, from Abu Bakr al-Hadrami, from al-Mu'alla: Imam (a.s) said: "Take the wealth of the ‘hostile opponent’ (nasibi) wherever you find it, and send to us (Ahlul Bayt (a.s)) the fifth (khums)."

Hadith 9

سَعْدُ بْنُ عَبْدِ اَللَّهِ عَنْ أَبِي جَعْفَرٍ عَنْ عَلِيِّ بْنِ مَهْزِيَارَ عَنْ مُحَمَّدِ بْنِ اَلْحَسَنِ اَلْأَشْعَرِيِّ قَالَ: كَتَبَ بَعْضُ أَصْحَابِنَا إِلَى أَبِي جَعْفَرٍ اَلثَّانِي عَلَيْهِ اَلسَّلاَمُ أَخْبِرْنِي عَنِ اَلْخُمُسِ أَ عَلَى جَمِيعِ مَا يَسْتَفِيدُ اَلرَّجُلُ مِنْ قَلِيلٍ وَ كَثِيرٍ مِنْ جَمِيعِ اَلضُّرُوبِ وَ عَلَى اَلصُّنَّاعِ وَ كَيْفَ ذَلِكَ فَكَتَبَ بِخَطِّهِ» اَلْخُمُسُ بَعْدَ اَلْمَئُونَةِ«.

Sa'd ibn Abdullah, from Abu Ja'far, from Ali ibn Mahziyar, from Muhammad ibn al-Hasan al-Ash'ari, who said: Some of our companions wrote to Abu Ja'far the Second (a.s), peace be upon him: “Inform us about ‘the fifth (khums), Is it upon everything that a man gains, whether little or much, from all types, and upon craftsmen? And how is that?’” Imam (a.s) wrote in his handwriting: "The fifth (khums) is after the expenses."

Hadith 10

عَلِيُّ بْنُ مَهْزِيَارَ قَالَ قَالَ لِي أَبُو عَلِيِّ بْنُ رَاشِدٍ: قُلْتُ لَهُ أَمَرْتَنِي بِالْقِيَامِ بِأَمْرِكَ وَ أَخْذِ حَقِّكَ فَأَعْلَمْتُ مَوَالِيَكَ ذَلِكَ فَقَالَ لِي بَعْضُهُمْ وَأَيُّ شَيْءٍ حَقُّهُ فَلَمْ أَدْرِ مَا أُجِيبُهُ فَقَالَ» يَجِبُ عَلَيْهِمُ اَلْخُمُسُ« فَقُلْتُ فَفِي أَيِّ شَيْءٍ فَقَالَ» فِي أَمْتِعَتِهِمْ وَضِيَاعِهِمْ« قَالَ وَاَلتَّاجِرُ عَلَيْهِ وَاَلصَّانِعُ بِيَدِهِ فَقَالَ» ذَلِكَ إِذَا أَمْكَنَهُمْ بَعْدَ مَئُونَتِهِمْ«.

Ali ibn Mahziyar said: Abu Ali ibn Rashid said to me: I (narrator) said to Imam (a.s): “You commanded me to undertake your affair and to take your right (khums), so I informed your followers of that. Then some of them said to me, ‘And what thing is his right?’ But I did not know what to answer him. Imam (a.s) said: "The fifth (khums) is obligatory upon them." So I (narrator) asked: “In what thing?” Imam (a.s) said: "In their goods and their estates." He (narrator) said: “And is it upon the merchant and the craftsman who works with his hand?” Imam (a.s) said: "That is when it is possible for them after their expenses."

Hadith 11

عَلِيُّ بْنُ مَهْزِيَارَ قَالَ: كَتَبَ إِلَيْهِ إِبْرَاهِيمُ بْنُ مُحَمَّدٍ اَلْهَمْدَانِيُّ أَقْرَأَنِي عَلِيٌّ كِتَابَ أَبِيكَ فِيمَا أَوْجَبَهُ عَلَى أَصْحَابِ اَلضِّيَاعِ» أَنَّهُ أَوْجَبَ عَلَيْهِمْ نِصْفَ اَلسُّدُسِ بَعْدَ اَلْمَئُونَةِ وَأَنَّهُ لَيْسَ عَلَى مَنْ لَمْ تَقُمْ ضَيْعَتُهُ بِمَئُونَتِهِ نِصْفُ اَلسُّدُسِ وَلاَ غَيْرُ ذَلِكَ« فَاخْتَلَفَ مَنْ قِبَلَنَا فِي ذَلِكَ فَقَالُوا يَجِبُ عَلَى اَلضِّيَاعِ اَلْخُمُسُ بَعْدَ اَلْمَئُونَةِ مَئُونَةِ اَلضَّيْعَةِ وَخَرَاجِهَا لاَ مَئُونَةِ اَلرَّجُلِ وَ عِيَالِهِ فَكَتَبَ وَقَرَأَهُ عَلِيُّ بْنُ مَهْزِيَارَ» عَلَيْهِ اَلْخُمُسُ بَعْدَ مَئُونَتِهِ وَ مَئُونَةِ عِيَالِهِ وَ بَعْدَ خَرَاجِ اَلسُّلْطَانِ«.

Ali ibn Mahziyar said: Ibrahim ibn Muhammad al-Hamdani wrote to him: Ali (ibn Mahziyar) read to me your father's (Imam al-Jawad (a.s)) letter concerning what He (a.s) had made obligatory upon the owners of estates: "That He (Imam al-Jawad (a.s)) made obligatory upon them half of one-sixth after the expenses (maunah), and that there is not upon one whose estate does not cover his expenses half of one-sixth, nor anything other than that." So those before us differed concerning that and said: “The fifth is obligatory upon estates after the expenses, meaning the expenses of the estate and its land-tax, not the expenses of the man and his dependants.” Imam al-Hadi (a.s) wrote, and Ali ibn Mahziyar read it: "Upon him is the fifth (khums) after his expenses, the expenses of his dependants, and after the tax of the ruler."

Hadith 12

سَعْدُ بْنُ عَبْدِ اَللَّهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ اَلْحَسَنِ بْنِ مَحْبُوبٍ عَنْ أَبِي أَيُّوبَ إِبْرَاهِيمَ بْنِ عُثْمَانَ عَنْ أَبِي عُبَيْدَةَ اَلْحَذَّاءِ قَالَ سَمِعْتُ أَبَا جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ يَقُولُ:» أَيُّمَا ذِمِّيٍّ اِشْتَرَى مِنْ مُسْلِمٍ أَرْضاً فَإِنَّ عَلَيْهِ اَلْخُمُسَ«.

Sa'd ibn Abdullah, from Ahmad ibn Muhammad, from al-Hasan ibn Mahbub, from Abu Ayyub Ibrahim ibn Uthman, from Abu Ubaydah al-Hadhdha, who said: I (narrator) heard Abu Ja’far (a.s), peace be upon him, saying: "Whichever dhimmi (protected non-Muslim resident) buys land from a Muslim, then upon him is the fifth (khums)."

Hadith 13

وَ عَنْهُ عَنْ مُحَمَّدِ بْنِ اَلْحُسَيْنِ بْنِ أَبِي اَلْخَطَّابِ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ مُحَمَّدِ بْنِ عَلِيِّ بْنِ أَبِي عَبْدِ اَللَّهِ عَنْ أَبِي اَلْحَسَنِ عَلَيْهِ اَلسَّلاَمُ قَالَ: سَأَلْتُهُ عَمَّا يُخْرَجُ مِنَ اَلْبَحْرِ مِنَ اَللُّؤْلُؤِ وَاَلْيَاقُوتِ وَاَلزَّبَرْجَدِ وَ عَنْ مَعَادِنِ اَلذَّهَبِ وَ اَلْفِضَّةِ هَلْ عَلَيْهِ زَكَاتُهَا فَقَالَ» إِذَا بَلَغَ قِيمَتُهُ دِينَاراً فَفِيهِ اَلْخُمُسُ«.

And from him, from Muhammad ibn al-Husayn ibn Abi al-Khattab, from Ahmad ibn Muhammad ibn Abi Nasr, from Muhammad ibn Ali ibn Abi Abdullah, from Abu al-Hasan (a.s), peace be upon him, who said: I (narrator) asked Imam (a.s) about ‘what is brought out from the sea, of pearls, rubies, and emeralds, and about mines of gold and silver. Is their zakat upon them?’ Imam (a.s) said: "When its value reaches a dinar, then in it is the fifth (khums)."

Hadith 14

وَ عَنْهُ عَنْ عَلِيِّ بْنِ إِسْمَاعِيلَ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ عَبْدِ اَللَّهِ بْنِ مُسْكَانَ عَنِ اَلْحَلَبِيِّ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ: فِي اَلرَّجُلِ مِنْ أَصْحَابِنَا يَكُونُ فِي لِوَائِهِمْ فَيَكُونُ مَعَهُمْ فَيُصِيبُ غَنِيمَةً قَالَ» يُؤَدِّي خُمُسَهَا وَيَطِيبُ لَهُ«.

And from him, from Ali ibn Ismail, from Safwan ibn Yahya, from Abdullah ibn Muskan, from al-Halabi, from Abu Abdillah (a.s), peace be upon him: (Imam (a.s) was asked) concerning ‘a man from among our companions who is under their banner, and is with them, and obtains spoils.’ Imam (a.s) said: "He pays its fifth (khums), and it (spoils) becomes lawful for him."

Hadith 15

وَ عَنْهُ عَنْ يَعْقُوبَ بْنِ يَزِيدَ عَنْ عَلِيِّ بْنِ جَعْفَرٍ عَنِ اَلْحَكَمِ بْنِ بُهْلُولٍ عَنْ أَبِي هَمَّامٍ عَنِ اَلْحَسَنِ بْنِ زِيَادٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» إِنَّ رَجُلاً أَتَى أَمِيرَ اَلْمُؤْمِنِينَ عَلَيْهِ اَلسَّلاَمُ فَقَالَ يَا أَمِيرَ اَلْمُؤْمِنِينَ إِنِّي أَصَبْتُ مَالاً لاَ أَعْرِفُ حَلاَلَهُ مِنْ حَرَامِهِ فَقَالَ» أَخْرِجِ اَلْخُمُسَ مِنْ ذَلِكَ اَلْمَالِ فَإِنَّ اَللَّهَ تَعَالَى قَدْ رَضِيَ مِنَ اَلْمَالِ بِالْخُمُسِ وَ اِجْتَنِبْ مَا كَانَ صَاحِبُهُ يَعْمَلُ««.

And from him, from Ya'qub ibn Yazid, from Ali ibn Ja'far, from al-Hakam ibn Buhlul, from Abu Hammam, from al-Hasan ibn Ziyad, from Abu Abdillah (a.s), peace be upon him, who said: Imam al-Sadiq (a.s) said: "A man came to the Commander of the Believers (a.s), peace be upon him, and said: ‘O Commander of the Believers (a.s), I have acquired wealth whose lawful from its unlawful I do not know.’ Imam Ali (a.s) said: “Take out the fifth (khums) from that wealth, for Allah (swt), Exalted is He (swt), has been pleased with the fifth (khums) from wealth, and avoid what its owner used to do."

Hadith 16

فَأَمَّا مَا رَوَاهُ اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنْ عَبْدِ اَللَّهِ بْنِ سِنَانٍ قَالَ سَمِعْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ يَقُولُ:» لَيْسَ اَلْخُمُسُ إِلاَّ فِي اَلْغَنَائِمِ خَاصَّةً«.

As for what al-Hasan ibn Mahbub narrated from Abdullah ibn Sinan, who said: I heard Abu Abdillah (a.s), peace be upon him, saying: "The fifth (khums) is only in spoils specifically."

Commentary 2

فالمراد به ليس الخمس بظاهر القرآن إلا في الغنائم خاصة لان ما عدا الغنائم التي أوجبنا فيها الخمس انما يثبت ذلك كله بالسنة، ولم يرد عليه السلام انه ليس فيه الخمس على كل حال.

What is intended by it is that the one-fifth levy (khums) is not established by the apparent wording of the Quran except specifically in spoils, because whatever is other than the spoils in which we have made the one-fifth levy (khums) obligatory, all of that is only established by the Sunnah. And the Imam (a.s), peace be upon him, did not mean that there is no one-fifth levy (khums) in it in every circumstance.
