5307 - وَ رَوَى اَلْحَسَنُ بْنِ مَحْبُوبٍ عَنْ أَبِي وَلاَّدٍ قَالَ: سَأَلْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنْ رَجُلٍ قُتِلَ وَ لَهُ أَوْلاَدٌ صِغَارٌ وَ كِبَارٌ أَ رَأَيْتَ إِنْ عَفَا أَوْلاَدُهُ اَلْكِبَارُ فَقَالَ "لاَ يُقْتَلُ وَ يَجُوزُ عَفْوُ اَلْكِبَارِ فِي حِصَصِهِمْ فَإِذَا كَبِرَ اَلصِّغَارُ كَانَ لَهُمْ أَنْ يَطْلُبُوا حَقَّهُمْ مِنَ اَلدِّيَةِ". وَ قَدْ رُوِيَ: "أَنَّهُ إِذَا عَفَا وَاحِدٌ مِنَ اَلْأَوْلِيَاءِ عَنِ اَلدَّمِ اِرْتَفَعَ اَلْقَوَدُ".
Hadith.5307 - Al-Hasan ibn Mahbub narrated from Abu Walad who said:
I asked Abu Abdullah about a man who was killed and had both young and adult children.
I asked: "What if his adult children forgave (the murderer)?"
Imam
replied: "The murderer will not be killed, and the forgiveness of the adults is valid concerning their shares. When the younger children reach adulthood, they have the right to claim their share of the blood money (diyyah)."
It has also been narrated: "If one of the heirs forgives regarding the blood, the retribution (qisas) is nullified."
