قَالَ مُصَنِّفُ هَذَا الْكِتَابِ رَحِمَهُ اللَّهُ لَوْ تَزَوَّجَهَا فِي نِفَاسِهَا وَ لَمْ يَدْخُلْ بِهَا حَتَّى تَطْهُرَ لَمْ يَجِبْ عَلَيْهِ الْحَدُّ وَ إِنَّمَا حَدَّهُ ع لِأَنَّهُ دَخَلَ بِهَا.
The author of this book, may Allah سبحانه وتعالى have mercy on him, commented: If he had married her during her postpartum bleeding but did not consummate the marriage until she became pure, then the prescribed punishment would not have been obligatory upon him. The punishment was applied because he consummated the marriage with her.
