عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللَّهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ قَالَ سَأَلْتُ أَبَا الْحَسَنِ الرِّضَا ( عليه السلام ) عَنْ رَجُلٍ يَصِيدُ الطَّيْرَ يُسَاوِي دَرَاهِمَ كَثِيرَةً وَ هُوَ مُسْتَوِي الْجَنَاحَيْنِ وَ يَعْرِفُ صَاحِبَهُ أَوْ يَجِيئُهُ فَيَطْلُبُهُ مَنْ لَا يَتَّهِمُهُ قَالَ لَا يَحِلُّ لَهُ إِمْسَاكُهُ يَرُدُّهُ عَلَيْهِ فَقُلْتُ لَهُ فَإِنْ هُوَ صَادَ مَا هُوَ مَالِكٌ بِجَنَاحَيْهِ لَا يَعْرِفُ لَهُ طَالِباً قَالَ هُوَ لَهُ .
1. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from Ahmad ibn Muhammad from ibn abu Nasr who has said the following: “I once asked al-Rida 5 , ‘Alayhi al-Salam, about the case of a man who hunts a bird which is worth a large amount of dirham and it has leveled wings. He knows the owner of the bird or that he comes to ask about the bird but does not accuse him. He (the Imam) said, ‘It is not lawful for him to keep. He must return it to him.’ I then asked, ‘What happens if he hunts that which has control over its wings and no one asking for it is known ? 5 He (the Imam) said, ‘It becomes his property. 5 ”
عَنْهُ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَمَّنْ رَوَاهُ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ إِذَا مَلَكَ الطَّائِرُ جَنَاحَهُ فَهُوَ لِمَنْ أَخَذَهُ .
2. It is narrated from the narrator of the previous Hadith from ibn Faddal from ibn Bukayr from those who narrated to him who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘If a bird has full control over its wings (is able to fly) it then belongs to whoever catches it . 555
عَنْهُ عَنِ ابْنِ فَضَّالٍ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ قَالَ سَأَلْتُ أَبَا الْحَسَنِ ( عليه السلام ) عَنْ صَيْدِ الْحَمَامَةِ تُسَاوِي نِصْفَ دِرْهَمٍ أَوْ دِرْهَماً فَقَالَ إِذَا عَرَفْتَ صَاحِبَهُ فَرُدَّهُ عَلَيْهِ وَ إِنْ لَمْ تَعْرِفْ صَاحِبَهُ وَ كَانَ مُسْتَوِيَ الْجَنَاحَيْنِ يَطِيرُ بِهِمَا فَهُوَ لَكَ .
3. It is narrated from the narrator of the previous Hadith from ibn Faddal from Muhammad ibn al-Fudayl who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about hunting pigeons worth one-half of a dirham or one dirham. He (the Imam) said, ‘If you know its owner return it to him; but if you do not know its owner and its wings are complete with both of which it can fly then it is yours . 555
وَ عَنْهُ عَنِ ابْنِ فَضَّالٍ عَنْ عُبَيْدِ بْنِ حَفْصِ بْنِ قُرْطٍ عَنْ إِسْمَاعِيلَ بْنِ جَابِرٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ قُلْتُ لَهُ جُعِلْتُ فِدَاكَ الطَّيْرُ يَقَعُ عَلَى الدَّارِ فَيُؤْخَذُ أَ حَلَالٌ هُوَ أَمْ حَرَامٌ لِمَنْ أَخَذَهُ فَقَالَ يَا إِسْمَاعِيلُ عَافٍ أَمْ غَيْرُ عَافٍ قَالَ قُلْتُ جُعِلْتُ فِدَاكَ وَ مَا الْعَافِي قَالَ الْمُسْتَوِي جَنَاحَاهُ الْمَالِكُ جَنَاحَيْهِ يَذْهَبُ حَيْثُ شَاءَ قَالَ هُوَ لِمَنْ أَخَذَهُ حَلَالٌ .
4. It is narrated from the narrator of the previous Hadith from ibn Faddal from ‘Ubayd ibn Fiafs ibn al-Qurt from ’Isma‘il ibn Jabir who has said the following: “I once said to abu ‘Abd Allah, ‘Alayhi al-Salam, I pray to Allah to keep my soul in service for your cause, if a bird is trapped in the house and it is taken, is taking it lawful or unlawful. He (the Imam) asked, ‘O ’Isma‘il is it healthy or it is not healthy and free ? 5 I then asked, ‘I pray to Allah to keep my soul in service for your cause, what is healthy ? 5 He (the Imam) said, ‘It is one with complete wings with full control on them and is able to fly wherever it wants . 5 He (the Imam) said, ‘Such ones belong to whoever catches them . 555
عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ قَالَ أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) إِنَّ الطَّيْرَ إِذَا مَلَكَ جَنَاحَيْهِ فَهُوَ صَيْدٌ وَ هُوَ حَلَالٌ لِمَنْ أَخَذَهُ .
5. Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that ’Amir al-Mu 5 minin has said, ‘The birds which have full control over their wings, belong to whoever catches them and they are lawful for them . 555
وَ بِإِسْنَادِهِ أَنَّ أَمِيرَ الْمُؤْمِنِينَ ( عليه السلام ) قَالَ فِي رَجُلٍ أَبْصَرَ طَائِراً فَتَبِعَهُ حَتَّى سَقَطَ عَلَى شَجَرَةٍ فَجَاءَ رَجُلٌ آخَرُ فَأَخَذَهُ فَقَالَ أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) لِلْعَيْنِ مَا رَأَتْ وَ لِلْيَدِ مَا أَخَذَتْ .
6. Through the same chain of narrators as that of the previous Hadith the following is narrated: “About a man who sees a bird and follows it until it sits on a tree and another man comes and takes it, ’Amir al-Mu 5 minin, ‘Alayhi al-Salam, has said, ‘For an eye is what it has seen and for hands is what they catch 5 ”
