65. Waiting Period for al-KhuP and al-Mubarat (disavowing), the Maintenance and Housing for such Women

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ عَبْدِ الْكَرِيمِ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ عِدَّةُ الْمُخْتَلِعَةِ مِثْلُ عِدَّةِ الْمُطَلَّقَةِ وَ خُلْعُهَا طَلَاقُهَا .


1. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from ‘Abd al-Karim from ibn abu Nasr who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that waiting period for al-Khul‘ is like the waiting period for divorced woman and al-Khul‘ is her divorce.’”

Allamah Baqir al-Majlisi: ضعيف على المشهور - Mir‘at al ‘Uqul Fi Sharh Akhbar Al al Rasul (1/241)



وَ بِإِسْنَادِهِ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَبْدِ الْكَرِيمِ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ لَا تُمَتَّعُ الْمُخْتَلِعَةُ .


2. Through the same chain of narrators as that of the previous Hadith the following is narrated Ahmad ibn Muhammad from ‘Abd al- Karim from al-Halabiy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that a woman because of al-Khul‘ does not receive any benefit.’”

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ قَالَ الْمُخْتَلِعَةُ لَا تُمَتَّعُ .


3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad from al-Halabiy who has said the following: “He (the Imam) ‘Alayhi al-Salam, has said that woman of al-Khul‘ does not receive any benefits.’”

الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ الْوَشَّاءِ عَنْ أَبَانٍ عَنْ زُرَارَةَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ ( عليه السلام ) عَنْ عِدَّةِ الْمُخْتَلِعَةِ كَمْ هِيَ قَالَ عِدَّةُ الْمُطَلَّقَةِ وَ لْتَعْتَدَّ فِي بَيْتِهَا وَ الْمُبَارِئَةُ بِمَنْزِلَةِ الْمُخْتَلِعَةِ .


4. Al-Husayn from Muhammad has narrated from Mu‘alla’ ibn Muhammad from al-Hassan ibn Ali al-Washsha’ from Aban from Zurarah who has said the following: “I once asked abu Ja‘far, ‘Alayhi al-Salam, about the waiting period of a woman in al-Khul‘. He (the Imam) said, ‘It is like the waiting period of a divorced woman and she must complete her waiting period in her home and a woman in al-Mubarat (disavowing) is the same as the one in al-Khul‘.’”

حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ عَنْ مُحَمَّدِ بْنِ زِيَادٍ عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ عِدَّةُ الْمُخْتَلِعَةِ عِدَّةُ الْمُطَلَّقَةِ وَ خُلْعُهَا طَلَاقُهَا قَالَوَ سَأَلْتُهُ هَلْ تُمَتَّعُ بِشَيْ‏ءٍ قَالَ لَا .


5. Humayd ibn Ziyad has narrated from ibn Sama‘ah from Muhammad ibn Ziyad from ‘Abd Allah ibn Sinan who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that waiting period for a woman in al-Khul‘ is like that of a divorced woman and her al-Khul‘ is her divorce.’ He (the narrator) has said that he then asked if she receives any benefits. He (the Imam) said, ‘No, she does not receive any benefits.’”

حُمَيْدٌ عَنِ الْحَسَنِ عَنْ جَعْفَرِ بْنِ سَمَاعَةَ عَنْ دَاوُدَ بْنِ سِرْحَانَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) فِي الْمُخْتَلِعَةِ قَالَ عِدَّتُهَا عِدَّةُ الْمُطَلَّقَةِ وَ تَعْتَدُّ فِي بَيْتِهَا وَ الْمُخْتَلِعَةُ بِمَنْزِلَةِ الْمُبَارِئَةِ .


6. Humayd has narrated from al-Hassan from Ja‘far ibn Sama‘ah from Dawud ibn Sarhan who has said the following: “About the case of a woman in al-Khul‘ abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Her waiting period is like the waiting period of a divorced woman. She must count her waiting period in her home and a woman of al-Khul‘ is like the woman in al-Mubarat (disavowing).”’

حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ عَنْ مُحَمَّدِ بْنِ زِيَادٍ وَ صَفْوَانَ عَنْ رِفَاعَةَ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ الْمُخْتَلِعَةُ لَا سُكْنَى لَهَا وَ لَا نَفَقَةَ .


7. Humayd ibn Ziyad has narrated from al-Hassan from Muhammad ibn Ziyad and Safwan from Rifa‘ah who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that women in al-Khul‘ do not have the right for maintenance and housing.’”

مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْبَرْقِيِّ عَنْ أَبِي الْبَخْتَرِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ قَالَ أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) لِكُلِّ مُطَلَّقَةٍ مُتْعَةٌ إِلَّا الْمُخْتَلِعَةَ فَإِنَّهَا اشْتَرَتْ نَفْسَهَا .


8. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Barqiy from abu al-Bakhtariy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that ’Amir al-Mu’minin has said, ‘Every divorced woman has the right to receive benefits except women in al-Khul‘ who purchase themselves.’”

مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنِ ابْنِ رِئَابٍ عَنْ أَبِي بَصِيرٍعَنْ أَبِي عَبْدِ اللَّهِ ( عليه السلام ) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ اخْتَلَعَتْ مِنْهُ امْرَأَتُهُ أَ يَحِلُّ لَهُ أَنْ يَخْطُبَ أُخْتَهَا مِنْ قَبْلِ أَنْ تَنْقَضِيَ عِدَّةُ الْمُخْتَلِعَةِ قَالَ نَعَمْ قَدْ بَرِئَتْ عِصْمَتُهَا مِنْهُ وَ لَيْسَ لَهُ عَلَيْهَا رَجْعَةٌ .


9. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ibn Ri’ab from abu Basir who has said the following: “I once asked abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man whose wife has arranged al- Khul‘: if it is permissible for him to propose marriage to her sister before waiting period because of al-KhuV is complete. He (the Imam) said, ‘Yes, because she has freed herself from the bonds of his marriage and he does not have the right to go back to her.’”
