Liability of Technician or Person with a Certain Skill
10 Aḥadīth

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (a.s) قَالَ سُئِلَ عَنِ الْقَصَّارِ يُفْسِدُ قَالَ كُلُّ أَجِيرٍ يُعْطَى الأجْرَ عَلَى أَنْ يُصْلِحَ فَيُفْسِدُ فَهُوَ ضَامِنٌ.


1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Hammad from al-Halabiy who has said the following: “Once abu ‘ Abd Allah (a.s), was asked about a cleaner who destroyed. He (the Imam) said, ’Everyone hired and paid for mending an item is liable if the item is destroyed.”’

2- عَنْهُ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (a.s) قَالَ فِي الْغَسَّالِ وَالصَّبَّاغِ مَا سُرِقَ مِنْهُمَا مِنْ شَيْ‏ءٍ فَلَمْ يَخْرُجْ مِنْهُ عَلَى أَمْرٍ بَيِّنٍ أَنَّهُ قَدْ سُرِقَ وَكُلَّ قَلِيلٍ لَهُ أَوْ كَثِيرٍ فَإِنْ فَعَلَ فَلَيْسَ عَلَيْهِ شَيْ‏ءٌ وَإِنْ لَمْ يُقِمِ الْبَيِّنَةَ وَزَعَمَ أَنَّهُ قَدْ ذَهَبَ الَّذِي ادُّعِيَ عَلَيْهِ فَقَدْ ضَمِنَهُ إِنْ لَمْ يَكُنْ لَهُ بَيِّنَةٌ عَلَى قَوْلِهِ.


2. It is narrated from the narrator of the previous Hadith from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ’Abd Allah (a.s), has said, ‘In the case of cleaners and dyers and the items stolen from them with no clear evidence that he has stolen, of small or large quantities, if it happens, there is nothing on him, if no evidence is presented to prove it to be his doing; but if he thinks the claimant has done it, he is liable if he fails to present evidence in support of what he says.’”

3- وَبِهَذَا الإسْنَادِ قَالَ قَالَ أَبُو عَبْدِ اللهِ (a.s) وَكَانَ أَمِيرُ الْمُؤْمِنِينَ (a.s) يُضَمِّنُ الْقَصَّارَ وَالصَّائِغَ احْتِيَاطاً لِلنَّاسِ وَكَانَ أَبِي يَتَطَوَّلُ عَلَيْهِ إِذَا كَانَ مَأْمُوناً.


3. Through the same chain of narrators as that of the previous Hadith the following is narrated: “Abu ‘Abd Allah (a.s), has said that ’Amir al-Mu’minin, would hold a cleaner liable as well as a dyer as precautionary measures to protect the interests of the people but my father would deal with them more graciously if they were trusted ones.’”

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَمَّنْ ذَكَرَهُ عَنِ ابْنِ مُسْكَانَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللهِ (a.s) قَالَ سَأَلْتُهُ عَنْ قَصَّارٍ دَفَعْتُ إِلَيْهِ ثَوْباً فَزَعَمَ أَنَّهُ سُرِقَ مِنْ بَيْنِ مَتَاعِهِ قَالَ فَعَلَيْهِ أَنْ يُقِيمَ الْبَيِّنَةَ أَنَّهُ سُرِقَ مِنْ بَيْنِ مَتَاعِهِ وَلَيْسَ عَلَيْهِ شَيْ‏ءٌ وَإِنْ سُرِقَ مَتَاعُهُ كُلُّهُ فَلَيْسَ عَلَيْهِ شَيْ‏ءٌ.


4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from those whom he has mentioned from ibn Muskan from abu Basir who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s), about the case of a cleaner to whom I gave a cloth and he thought it was stolen from his goods. He (the Imam) said, ‘He is required to present evidence that it is stolen from his goods; then there is nothing on him and if all of his goods are stolen he is not liable for anything.’”

5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللهِ (a.s) قَالَ كَانَ أَمِيرُ الْمُؤْمِنِينَ (a.s) يُضَمِّنُ الْقَصَّارَ وَالصَّبَّاغَ وَالصَّائِغَ احْتِيَاطاً عَلَى أَمْتِعَةِ النَّاسِ وَكَانَ لا يُضَمِّنُ (a.s) مِنَ الْغَرَقِ وَالْحَرَقِ وَالشَّيْ‏ءِ الْغَالِبِ وَإِذَا غَرِقَتِ السَّفِينَةُ وَمَا فِيهَا فَأَصَابَهُ النَّاسُ فَمَا قَذَفَ بِهِ الْبَحْرُ عَلَى سَاحِلِهِ فَهُوَ لأهْلِهِ وَهُمْ أَحَقُّ بِهِ وَمَا غَاصَ عَلَيْهِ النَّاسُ وَتَرَكَهُ صَاحِبُهُ فَهُوَ لَهُمْ.


5. Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah (a.s), has said that ‘Amir al-Mu’minin would hold cleaners, jewelers and dyers liable as precautionary measure to protect the interests of the people; but he would not hold them liable for things burnt or drowned. When a ship drowned with its contents and people found things thrown on shore, it was for the people of the area because of their being more rightful in the case. Whatever people found by diving and the owner had abandoned, it was considered their things.’”

6- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي نَجْرَانَ عَنْ صَفْوَانَ عَنِ الْكَاهِلِيِّ عَنْ أَبِي عَبْدِ اللهِ (a.s) قَالَ سَأَلْتُهُ عَنِ الْقَصَّارِ يُسَلَّمُ إِلَيْهِ الثَّوْبُ وَاشْتُرِطَ عَلَيْهِ أَنْ يُعْطِيَ فِي وَقْتٍ قَالَ إِذَا خَالَفَ الْوَقْتَ وَضَاعَ الثَّوْبُ بَعْدَ الْوَقْتِ فَهُوَ ضَامِنٌ.


6. Ali ibn Ibrahim has narrated from his father from ibn abu Najran from Safwan from al-Kahiliy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s), about the case of a cleaner man to whom I gave clothes with a condition to return at a given time. He (the Imam) said, ‘If he violates the time and clothes are lost after the given time he is liable.’”

7- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ إِسْمَاعِيلَ بْنِ أَبِي الصَّبَّاحِ عَنْ أَبِي عَبْدِ اللهِ (a.s) قَالَ سَأَلْتُهُ عَنِ الثَّوْبِ أَدْفَعُهُ إِلَى الْقَصَّارِ فَيُحْرِقُهُ قَالَ أَغْرِمْهُ فَإِنَّكَ إِنَّمَا دَفَعْتَهُ إِلَيْهِ لِيُصْلِحَهُ وَلَمْ تَدْفَعْهُ إِلَيْهِ لِيُفْسِدَهُ.


7. A number of our people have narrated from Ahmad ibn Muhammad ibn Tsa from Ali ibn al-Hakam from Tsma’il ibn abu al-Sabbah who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s), about the case of a cleaner man to whom I gave clothes but he burnt them. He (the Imam) said, ‘You can make him compensate, you gave him for mending and not to destroy them.’”

8- أَحْمَدُ بْنُ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ غِيَاثِ بْنِ إِبْرَاهِيمَ عَنْ أَبِي عَبْدِ اللهِ (a.s) أَنَّ أَمِيرَ الْمُؤْمِنِينَ ﷺ أُتِيَ بِصَاحِبِ حَمَّامٍ وُضِعَتْ عِنْدَهُ الثِّيَابُ فَضَاعَتْ فَلَمْ يُضَمِّنْهُ وَقَالَ إِنَّمَا هُوَ أَمِينٌ.


8. Ahmad ibn Muhammad has narrated from Muhammad ibn Yahya from Ghiyath ibn Ibrahim who has said the following: “Abu ‘ Abd Allah (a.s), has said that once the owner of a public bath house with whom clothes were left and were lost, was brought before ’Amir al-Mu’minin (a.s), who did not hold him liable and said that he was trusted.’”

9- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللهِ (a.s) أَنَّ أَمِيرَ الْمُؤْمِنِينَ (a.s) رُفِعَ إِلَيْهِ رَجُلٌ اسْتَأْجَرَ رَجُلا لِيُصْلِحَ بَابَهُ فَضَرَبَ الْمِسْمَارَ فَانْصَدَعَ الْبَابُ فَضَمَّنَهُ أَمِيرُ الْمُؤْمِنِينَ (a.s).


9. Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah (a.s), has said that once a man who had hired another man to mend his door and who by driving a nail into the door had damaged it, came for judgment before ’Amir al- Mu’minin, and he (’Amir al-Mu’minin) held him liable for the door.’”

10- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ إِسْمَاعِيلَ بْنِ مَرَّارٍ عَنْ يُونُسَ قَالَ سَأَلْتُ الرِّضَا (a.s) عَنِ الْقَصَّارِ وَالصَّائِغِ أَيُضَمَّنُونَ قَالَ لا يُصْلِحُ النَّاسُ إِلا أَنْ يُضَمَّنُوا قَالَ وَكَانَ يُونُسُ يَعْمَلُ بِهِ وَيَأْخُذُ.


10. Ali ibn Ibrahim has narrated from his father from ‘Isma’il ibn Marrar from Yunus who has said the following: “I once asked al-Rida’ (a.s), about the case of a cleaner man and a jeweler if they were liable. He (the Imam) said, ‘People do not behave well unless they are held liable.’ Yunus would act accordingly and hold liable.’”
