Commentary 1

قال الشيخ رحمه الله:) والغنم إذا بلغت أربعين شاة وجب فيها شاة( الى آخر الباب

The Shaykh (Al-Mufid), may Allah (swt) bless him, said: “As for sheep, when they reach forty sheep, then one sheep becomes obligatory in them,” until the end of the chapter.

Hadith 1

مُحَمَّدُ بْنُ يَعْقُوبَ عَنْ عَلِيِّ بْنِ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادٍ عَنْ حَرِيزٍ عَنْ زُرَارَةَ وَ مُحَمَّدِ بْنِ مُسْلِمٍ وَ أَبِي بَصِيرٍ وَ بُرَيْدٍ اَلْعِجْلِيِّ وَاَلْفُضَيْلِ عَنْ أَبِي جَعْفَرٍ وَأَبِي عَبْدِ اَللَّهِ عَلَيْهِمَا اَلسَّلاَمُ:» فِي اَلشَّاةِ فِي كُلِّ أَرْبَعِينَ شَاةً شَاةٌ وَلَيْسَ فِيمَا دُونَ اَلْأَرْبَعِينَ شَيْءٌ ثُمَّ لَيْسَ فِيهَا شَيْءٌ حَتَّى تَبْلُغَ عِشْرِينَ وَ مِائَةً فَإِذَا بَلَغَتْ عِشْرِينَ وَ مِائَةً فَفِيهَا مِثْلُ ذَلِكَ شَاةٌ وَاحِدَةٌ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِيهَا شَاتَانِ وَلَيْسَ فِيهَا أَكْثَرُ مِنْ شَاتَيْنِ حَتَّى تَبْلُغَ مِائَتَيْنِ فَإِذَا بَلَغَتِ اَلْمِائَتَيْنِ فَفِيهَا مِثْلُ ذَلِكَ فَإِذَا زَادَتْ عَلَى اَلْمِائَتَيْنِ شَاةٌ وَاحِدَةٌ فَفِيهَا ثَلاَثُ شِيَاهٍ ثُمَّ لَيْسَ فِيهَا شَيْ ءٌأَكْثَرُ مِنْ ذَلِكَ حَتَّى تَبْلُغَ ثَلاَثَمِائَةٍ فَإِذَا بَلَغَتْ ثَلاَثَمِائَةٍ فَفِيهَا مِثْلُ ذَلِكَ ثَلاَثُ شِيَاهٍ فَإِذَا زَادَتْ وَاحِدَةٌ فَفِيهَا أَرْبَعُ شِيَاهٍ حَتَّى تَبْلُغَ أَرْبَعَمِائَةٍ فَإِذَا تَمَّتْ أَرْبَعُمِائَةٍ كَانَ عَلَى كُلِّ مِائَةٍ شَاةٌ وَ سَقَطَ اَلْأَمْرُ اَلْأَوَّلُ وَ لَيْسَ عَلَى مَا دُونَ اَلْمِائَةِ بَعْدَ ذَلِكَ شَيْءٌ وَ لَيْسَ فِي اَلنَّيِّفِ شَيْءٌ« وَ قَالاَ» كُلُّ مَا لاَ يَحُولُ عَلَيْهِ اَلْحَوْلُ عِنْدَ رَبِّهِ فَلاَ شَيْءَ عَلَيْهِ فَإِذَا حَالَ عَلَيْهِ اَلْحَوْلُ وَجَبَ عَلَيْهِ«.

Muhammad ibn Yaqub from Ali ibn Ibrahim from his father from Hammad from Hariz from Zurarah, Muhammad ibn Muslim, Abu Basir and Burayd al-Ijli and al-Fudayl from Abu Ja’far (a.s) and Abu Abdillah (a.s): Imam (a.s) said: “Regarding sheep, in every forty sheep, one sheep is due, and there is nothing due on fewer than forty. Then nothing further is due on them until they reach one hundred and twenty (sheep). When they reach 120 (sheep), the same ruling applies: one sheep is due. Then, if they increase beyond one hundred and twenty (sheep), two sheep are due on them, and nothing more than two sheep is due until they reach two hundred. Then, when they reach two hundred (sheep), the same ruling applies. Then, if they increase beyond two hundred (sheep) by one sheep, three sheep are due on them. Then nothing more than that is due until they reach three hundred (sheep). When they reach three hundred (sheep), the same ruling applies: three sheep are due. Then, if they increase by one, four sheep are due on them, until they reach 400 (sheep). Then, when four hundred (sheep) is complete, for every one hundred sheep, one sheep is due, and the previous calculation is dropped. Nothing is due on anything less than one hundred (sheep) after that, and nothing is due on the excess amount (al-nayyif).”

Hadith 2

سَعْدٌ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَبْدِ اَلرَّحْمَنِ بْنِ أَبِي نَجْرَانَ عَنْ عَاصِمِ بْنِ حُمَيْدٍ وَ اَلْحُسَيْنِ بْنِ سَعِيدٍ عَنِ اَلنَّضْرِ بْنِ سُوَيْدٍ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ:» لَيْسَ فِيمَا دُونَ اَلْأَرْبَعِينَ مِنَ اَلْغَنَمِ شَيْءٌ فَإِذَا كَانَتْ أَرْبَعِينَ فَفِيهَا شَاةٌ إِلَى عِشْرِينَ وَ مِائَةٍ فَإِذَا زَادَتْ وَاحِدَةٌ فَفِيهَا شَاتَانِ إِلَى اَلْمِائَتَيْنِ فَإِذَا زَادَتْ وَاحِدَةٌ فَفِيهَا ثَلاَثٌ مِنَ اَلْغَنَمِ إِلَى ثَلاَثِمِائَةٍ فَإِذَا كَثُرَتِ اَلْغَنَمُ فَفِي كُلِّ مِائَةٍ شَاةٌ وَ لاَ تُؤْخَذُ هَرِمَةٌ وَ لاَ ذَاتُ عَوَارٍ إِلاَّ أَنْ يَشَاءَ اَلْمُصَدِّقُ وَ لاَ يُفَرِّقُ بَيْنَ مُجْتَمِعٍ وَ لاَ يَجْمَعُ بَيْنَ مُتَفَرِّقٍ وَ يَعُدُّ صَغِيرَهَا وَكَبِيرَهَا«.

Sa’ad from Ahmad ibn Muhammad from Abd al-Rahman ibn Abi Najran from Asim ibn Humayd, and al-Husayn ibn Said from al-Nadr ibn Suwayd from Asim ibn Humayd from Muhammad ibn Qays from Abu Abdillah (a.s), peace be upon him, who said: Imam (a.s) said: “There is nothing due on fewer than forty sheep. When they reach forty, one sheep is due on them, up to one hundred and twenty. Then, if they increase by one, two sheep are due on them, up to two hundred. Then, if they increase by one, three sheep are due on them, up to three hundred. Then, when the sheep become numerous, for every one hundred sheep, one sheep is due. An old animal is not to be taken, nor one with a defect, unless the collector of charity wishes. What is gathered together is not to be separated, and what is separated is not to be gathered together. Its young and its old are counted.”

Commentary 2

قوله عليه السلام: ويعد صغيرها وكبيرها، يريد ما زاد على حول واحد لان ذلك قد يكون صغيرا بالاضافة إلى ما سنه أكبر منه، ولم يرد عليه السلام الصغار من الغنم التي لم يحل عليه الحول حسب ما قدمناه وسنوضحه من بعد ان شاء الله تعالى.

The saying of the Imam (a.s), peace be upon him: “Its small and its large are counted,” means those animals over which a full year has passed. Such an animal may still be considered small in relation to another animal that is older than it. The Imam (a.s), peace be upon him, did not intend young sheep over which a full year had not passed, according to what we have already presented, and we will clarify this afterwards, if Allah (swt), the Exalted, wills.
