Man Lā Yaḥḍuruh al-Faqīh

رَوَى مُعَاوِيَةُ بْنُ حُكَيْمٍ عَنْ عَلِيِّ بْنِ اَلْحَسَنِ بْنِ زَيْدٍ عَنْ مُشْمَعِلٍّ عَنْ أَبِي بَصِيرٍ قَالَ: سَأَلْتُ أَبَا جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ عَنِ اِمْرَأَةٍ مَاتَتْ وَ تَرَكَتْ زَوْجَهَا وَ لاَ وَارِثَ لَهَا غَيْرُهُ قَالَ "إِذَا لَمْ يَكُنْ غَيْرُهُ فَالْمَالُ لَهُ وَ اَلْمَرْأَةُ لَهَا اَلرُّبُعُ وَ مَا بَقِيَ فَلِلْإِمَامِ ".

Mu'awiyah ibn Hakeem narrated from Ali ibn Al-Hasan ibn Zayd from Mushma'il from Abu Basir who said: I asked Abu Jafar Imam Muhammad ibn Ali Al-Baqir (a.s) about a woman who passed away and left behind her husband with no other heirs. Imam (a.s) said: "If there are no other heirs, the wealth belongs to him. For a woman, she receives one-fourth, and whatever remains belongs to the Imam (a.s)."

قَالَ مُصَنِّفُ هَذَا الْكِتَابِ رَحِمَهُ اللَّهُ هَذَا فِي حَالِ ظُهُورِ الْإِمَامِ ع فَأَمَّا فِي حَالِ غَيْبَتِهِ فَمَتَى مَاتَ الرَّجُلُ وَ تَرَكَ امْرَأَةً وَ لَا وَارِثَ لَهُ غَيْرُهَا فَالْمَالُ لَهَا وَ تَصْدِيقُ ذَلِكَ.

The compiler of this book, may Allah (swt) have mercy on him, commented: This ruling applies during the presence of the Imam (a.s). However, during his occultation, if a man dies and leaves behind only a wife with no other heirs, the entire wealth belongs to her. This is confirmed by the relevant evidences.

مَا رَوَاهُ مُحَمَّدُ بْنُ أَبِي عُمَيْرٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ: فِي اِمْرَأَةٍ مَاتَتْ وَ تَرَكَتْ زَوْجَهَا قَالَ "فَالْمَالُ كُلُّهُ لَهُ" قُلْتُ اَلرَّجُلُ يَمُوتُ وَ يَتْرُكُ اِمْرَأَتَهُ قَالَ "اَلْمَالُ لَهَا".

Muhammad ibn Abi Umayr narrated from Aban ibn Uthman from Abu Basir who reported from Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (a.s) regarding a woman who passed away and left behind her husband. Imam (a.s) said: "All the wealth belongs to him." I asked: "What if a man dies and leaves behind his wife?" Imam (a.s) replied: "The wealth belongs to her."
