Chapter on a Man Who Bequeaths a Portion of His Wealth to Another and is Then Killed by Mistake
Hadith #2
وَ فِي خَبَرٍ آخَرَ:
سُئِلَ أَبُو عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنْ رَجُلٍ أَوْصَى بِثُلُثِ مَالِهِ ثُمَّ قُتِلَ خَطَأً قَالَ "ثُلُثُ دِيَتِهِ دَاخِلٌ فِي وَصِيَّتِهِ".
In another narration,
Abu Abdullah
عليه السلام
, was asked about a man who had bequeathed one-third of his wealth and was then killed by mistake. Imam
عليه السلام
said: "One-third of his blood money (diyyah) is included in his bequest."
