فمحمول على انه إذا بني على هذا الحد ولم يكن عن اختيار فلا بأس بالقعود عليه للضرورة، مع أنه ليس في الخبر انه رآه في حال الغائط أو البول مستقبل القبلة أو مستدبرها، وإنما قال رأيت كنيفا في منزله بهذه الصفة، ويجوز أن يكون قد عمل ذلك عن غير اذنه بأن يكون المنزل قد انتقل إليه وهو مبني على هذا الحد، وهذا يسقط التعلق بهذا الخبر. ثم قال الشيخ:( ولا ينبغي له أن يتكلم على الغائط إلا أن تدعوه ضرورة إلى ذلك أو يذكر الله تعالى فيحمده أو يسمع ذكر الرسول فيصلي عليه وعلى أهل بيته وما أشبه ذلك مما يجب في كل حال). فيدل على ذلك:
This is interpreted as being permissible if the structure was built in that manner without choice, and there is no issue in sitting there out of necessity. Moreover, the narration does not mention that Imam عليه السلام was seen relieving himself while facing or turning his back to the Qiblah. It merely states that a toilet in his house was observed to be in such a position. It is possible that it was constructed without his consent, such as the house having been transferred to him with the toilet already built in that manner. This invalidates reliance on this narration. Then the Shaykh (Al-Mufid) said: "It is not appropriate to speak while relieving oneself unless there is a necessity, or if one remembers Allah سبحانه وتعالى, the Exalted, and praises Him سبحانه وتعالى, or hears mention of the Prophet صلى الله عليه وعلى آله وسلم (may Allah سبحانه وتعالى bless him and his family), in which case one should send blessings upon him and his family, or in similar situations that are obligatory in all circumstances."
