Marriage of one Born out of Wedlock
5 Aḥadīth
Ḥadīth 1

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزِ بْنِ عَبْدِ اللهِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنِ الْخَبِيثَةِ أَتَزَوَّجُهَا قَالَ لا.

1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hur ibn ‘Abd Allah from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu Ja’far (a.s.), if I can marry the filthy (prostitute). He (the Imam) said, ’No, you cannot do so/”

Ḥadīth 2

2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) فِي الرَّجُلِ يَشْتَرِي الْجَارِيَةَ أَوْ يَتَزَوَّجُهَا لِغَيْرِ رِشْدَةٍ وَيَتَّخِذُهَا لِنَفْسِهِ فَقَالَ إِنْ لَمْ يَخَفِ الْعَيْبَ عَلَى وُلْدِهِ فَلا بَأْسَ.

2. Ali ibn Ibrahim has narrated from his father from Muhammad Ibn Abi ‘Umayr from Jamil ibn Darraj from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ’Abd Allah), ‘Alayhim al-Salam, about the case of a man who buys a slave-girl or marries her without proper wedlock and keeps her for his own self, he (the Imam) has said, ‘If he is not afraid of the stigma for his children, it is not unlawful.”’

Ḥadīth 3

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَعِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ عَبْدِ اللهِ بْنِ سِنَانٍ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَلَدُ الزِّنَا يُنْكَحُ قَالَ نَعَمْ وَلا يُطْلَبُ وَلَدُهَا.

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad Ahmad ibn Muhammad from certain persons of our people from Sahl ibn Ziyad from al-Hassan ibn Mahbub from ‘Abd Allah ibn Sinan who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about marriage with one born out of wedlock. He (the Imam) said, ‘Yes, but her children are not wanted.’”

Ḥadīth 4

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنِ الْخَبِيثَةِ يَتَزَوَّجُهَا الرَّجُلُ قَالَ لا وَقَالَ إِنْ كَانَ لَهُ أَمَةٌ وَطِئَهَا وَلا يَتَّخِذْهَا أُمَّ وَلَدِهِ.

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked abu Ja’far (a.s.), about the case of a man if he could marry the filthy (prostitute). He (the Imam) said, ‘No, he cannot do so.’ He (the Imam) said, ‘If he has a slave-girl with whom he has gone to bed but she must not be taken as the mother of his children.’” (He must use contraceptives)

Ḥadīth 5

5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سُئِلَ عَنِ الرَّجُلِ يَكُونُ لَهُ الْخَادِمُ وَلَدَ زِنًى عَلَيْهِ جُنَاحٌ أَنْ يَطَأَهَا قَالَ لا وَإِنْ تَنَزَّهَ عَنْ ذَلِكَ فَهُوَ أَحَبُّ إِلَيَّ.

5. Ali ibn Ibrahim has narrated from his father from Muhammad Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Once abu ‘Abd Allah (a.s.), was asked about the case of a man who has a servant born out of wedlock; if he can go to bed with her. He (the Imam) said, ‘No, if he stays clean of that, it is more likeable to me.’”
