Al-Kāfi - Volume 5 > Exchange of Animals for Cloth or Other Items of Goods
Hadith #1

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ عَنْ صَفْوَانَ بْنِ يَحْيَى وَابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ الْبَعِيرُ بِالْبَعِيرَيْنِ وَالدَّابَّةُ بِالدَّابَّتَيْنِ يَداً بِيَدٍ لَيْسَ بِهِ بَأْسٌ.

1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr and Muhammad ibn ‘Isma’il has narrated from af-Fadf ibn Shadhan from Safwan ibn Yahya and ibn abu ‘Umayr from Jamil from Zurarah who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘The exchange of one camel for two camels, one stumper for two at the same time is not harmful.”’



Hadith #2

2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ أَبِي عَبْدِ اللهِ الْبَرْقِيِّ رَفَعَهُ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَبْدِ اللهِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ بَيْعِ الْغَزْلِ بِالثِّيَابِ الْمَبْسُوطَةِ وَالْغَزْلُ أَكْثَرُ وَزْناً مِنَ الثِّيَابِ قَالَ لا بَأْسَ.

2. A number of our people have narrated from Ahmad ibn Muhammad from ibn abu ‘Abd Allah al-Barqiy in a marfu’ manner from ‘Abd al-Rahman ibn abu ‘Abd Allah who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of exchanging yarns for expanded fabrics while the yarn is heavier than fabrics in weight. He (the Imam) said, ‘It is not harmful.’”



Hadith #3

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ أَبَانٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَبْدِ اللهِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الْعَبْدِ بِالْعَبْدَيْنِ وَالْعَبْدِ بِالْعَبْدِ وَالدَّرَاهِمِ قَالَ لا بَأْسَ بِالْحَيَوَانِ كُلِّهِ يَداً بِيَدٍ.

3. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from Ali ibn al-Hakam from Aban ibn ‘Abd al-Rahman ibn abu ‘Abd Allah who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about exchanging one slave for two slaves and a slave for a slave and some dirhams. He (the Imam) said, ‘It is not harmful in the case of all animals if it (the deal) is simultaneous.’”



Hadith #4

4- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنِ الْحَسَنِ بْنِ عَلِيٍّ الْكُوفِيِّ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ سَعِيدِ بْنِ يَسَارٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الْبَعِيرِ بِالْبَعِيرَيْنِ يَداً بِيَدٍ وَنَسِيئَةً فَقَالَ نَعَمْ لا بَأْسَ إِذَا سَمَّيْتَ بِالأسْنَانِ جَذَعَيْنِ أَوْ ثَنِيَّيْنِ ثُمَّ أَمَرَنِي فَخَطَطْتُ عَلَى النَّسِيئَةِ.

4. Abu Ali al-Ash’ariy has narrated from al-Hassan ibn Ali al-Kufiy from ‘Uthman ibn ‘Isa from Sa‘id ibn Yasar who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about exchanging one camel for two camels in a hand in hand transaction and on credit. He (the Imam) said, ‘Yes, it is permissible if you name it in terms of age, Jadh‘ayn or Thaniyayn (kinds of camels in terms of age). He (the Imam) then commanded me to strike out the word ‘al-Nisyah’ (on credit perhaps because of Taqiyyah).



Hadith #5

5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي نَجْرَانَ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) لا يَبِيعُ رَاحِلَةً عَاجِلا بِعَشَرَةِ مَلاقِيحَ مِنْ أَوْلادِ جَمَلٍ فِي قَابِلٍ.

5. Ali ibn Ibrahim has narrated from his father from ibn abu Najran from ‘Asim ibn Humayd from Muhammad ibn Qays who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘The sale of one grown up camel in exchange for ten fetuses of camel to be born is not valid.’”



Hadith #6

6- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَمَّنْ ذَكَرَهُ عَنْ أَبَانٍ عَنْ مُحَمَّدٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ مَا كَانَ مِنْ طَعَامٍ مُخْتَلِفٍ أَوْ مَتَاعٍ أَوْ شَيْ‏ءٍ مِنَ الأشْيَاءِ يَتَفَاضَلُ فَلا بَأْسَ بِبَيْعِهِ مِثْلَيْنِ بِمِثْلٍ يَداً بِيَدٍ فَأَمَّا نَظِرَةً فَلا تَصْلُحُ.

6. Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from those whom he has mentioned from Aban from Muhammad who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘In the exchange of foodstuff of different kinds or other things with different quantities is not harmful in a hand in hand transaction but it is not valid on credit.’”



Hadith #7

7- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ غِيَاثِ بْنِ إِبْرَاهِيمَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّ أَمِيرَ الْمُؤْمِنِينَ كَرِهَ اللَّحْمَ بِالْحَيَوَانِ.

7. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn Yahya from Ghiyath ibn Ibrahim who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that ’Amir al-Mu’minin, ‘Alayhi al-Salam, disliked exchange of meat for animals.”



Hadith #8

8- مُحَمَّدُ بْنُ يَحْيَى وَغَيْرُهُ عَنْ مُحَمَّدِ بْنِ أَحْمَدَ عَنْ أَيُّوبَ بْنِ نُوحٍ عَنِ الْعَبَّاسِ بْنِ عَامِرٍ عَنْ دَاوُدَ بْنِ الْحُصَيْنِ عَنْ مَنْصُورٍ قَالَ سَأَلْتُهُ عَنِ الشَّاةِ بِالشَّاتَيْنِ وَالْبَيْضَةِ بِالْبَيْضَتَيْنِ قَالَ لا بَأْسَ مَا لَمْ يَكُنْ كَيْلا أَوْ وَزْناً.

8. Muhammad ibn Yahya and others have narrated from Muhammad Ahmad from Ayyub ibn Nuh from al-‘ Abbas ibn ‘Amir from Dawud ibn al-Husayn from Mansur who has said the following: “I once asked him (the Imam), ‘Alayhi al-Salam, about exchange of one sheep for two sheep, one egg for two eggs. He (the Imam) said, ’It is not harmful as long as it is not in measures and weighing.’”



Hadith #9

9- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ عَنْ جَعْفَرِ بْنِ سَمَاعَةَ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ إِسْمَاعِيلَ بْنِ الْفَضْلِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ قَالَ لِرَجُلٍ ادْفَعْ إِلَيَّ غَنَمَكَ وَإِبِلَكَ تَكُونُ مَعِي فَإِذَا وَلَدَتْ أَبْدَلْتُ لَكَ إِنْ شِئْتَ إِنَاثَهَا بِذُكُورِهَا أَوْ ذُكُورَهَا بِإِنَاثِهَا فَقَالَ إِنَّ ذَلِكَ فِعْلٌ مَكْرُوهٌ إِلا أَنْ يُبْدِلَهَا بَعْدَ مَا تُولَدُ وَيُعَرِّفَهَا.

9. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad from Ja’far ibn Sama‘ah from Aban ibn ‘Uthman from ‘Isma’il ibn al-Fadl who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who says to another man, ‘Send your sheep and camels to be kept and when they give birth, if you like, I will exchange their male with female or vice versa.’ He (the Imam) said, ‘It is a detestable act unless the exchange takes place after they give birth and he knows them, which is which.’”
