Brokerage and Brokerage Fees
5 Aḥadīth
Ḥadīth 1

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحُسَيْنِ بْنِ بَشَّارٍ عَنْ أَبِي الْحَسَنِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ يَدُلُّ عَلَى الدُّورِ وَالضِّيَاعِ وَيَأْخُذُ عَلَيْهِ الأجْرَ قَالَ هَذِهِ أُجْرَةٌ لا بَأْسَ بِهَا.

1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Al-Husayn ibn al-Bashshar who has said the following: “About the case of a broker who shows houses and assets for a certain amount of fee, abu al-Hassan (a.s.), said it is not unlawful.’”

Ḥadīth 2

2- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ أَوْ غَيْرِهِ عَنْ عَبْدِ اللهِ بْنِ سِنَانٍ قَالَ سُئِلَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَأَنَا أَسْمَعُ فَقَالَ لَهُ إِنَّا نَأْمُرُ الرَّجُلَ فَيَشْتَرِي لَنَا الأرْضَ وَالْغُلامَ وَالدَّارَ وَالْخَادِمَ وَنَجْعَلُ لَهُ جُعْلا قَالَ لا بَأْسَ بِذَلِكَ.

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from and others from ‘Abd Allah ibn Sinan who has said the following: “Once abu ‘Abd Allah (a.s.), was asked, when I was listening, ‘We order a man to buy land, slave, a house or a servant for us and assign a certain amount for him. He (the Imam) said, ‘It is not unlawful.’”

Ḥadīth 3

3- أَحْمَدُ بْنُ مُحَمَّدٍ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ بَعْضِ أَصْحَابِنَا مِنْ أَصْحَابِ الرَّقِيقِ قَالَ اشْتَرَيْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) جَارِيَةً فَنَاوَلَنِي أَرْبَعَةَ دَنَانِيرَ فَأَبَيْتُ فَقَالَ لَتَأْخُذَنَّ فَأَخَذْتُهَا وَقَالَ لا تَأْخُذْ مِنَ الْبَائِعِ.

3. Ahmad ibn Muhammad has narrated from Ibn Abi ‘Umayr from certain persons of our people of slave traders who has said the following: “I once bought a slave-girl for abu ‘Abd Allah (a.s.), and he (the Imam) gave me four dinars but I declined. He (the Imam) said, ‘You must take it’ and I took it and he (the Imam) said, ‘You must not take anything from the seller.’”

Ḥadīth 4

4- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَأَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ عَبْدِ اللهِ بْنِ سِنَانٍ قَالَ سَمِعْتُ أَبِي سَأَلَ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَأَنَا أَسْمَعُ فَقَالَ لَهُ رُبَّمَا أَمَرْنَا الرَّجُلَ فَيَشْتَرِي لَنَا الأرْضَ وَالدَّارَ وَالْغُلامَ وَالْجَارِيَةَ وَنَجْعَلُ لَهُ جُعْلا قَالَ لا بَأْسَ.

4. A number of our people have narrated from Sahl ibn Ziyad and Ahmad ibn Muhammad from ibn Mahbub from ‘Abd Allah ibn Sinan who has said the following: “Once, a man asked abu ‘Abd Allah (a.s.), when I was listening, ‘We perhaps order a man to buy for us land, house, slave or slave-girl and assign for him a certain amount. He (the Imam) said, ‘It is not unlawful.’”

Ḥadīth 5

5- وَعَنْهُمَا عَنِ ابْنِ مَحْبُوبٍ عَنْ أَبِي وَلادٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَغَيْرِهِ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالُوا قَالا لا بَأْسَ بِأَجْرِ السِّمْسَارِ إِنَّمَا هُوَ يَشْتَرِي لِلنَّاسِ يَوْماً بَعْدَ يَوْمٍ بِشَيْ‏ءٍ مَعْلُومٍ وَإِنَّمَا هُوَ مِثْلُ الأجِيرِ.

5. It is narrated from the two of them from ibn Mahbub from abu Wallad and others who has said the following: “They have said that abu Ja‘far (a.s.), has said, ‘Payment for brokerage fee to a broker who buys goods for people day after day is not unlawful.’”
