Hadith 1

رَوَى مُحَمَّدُ بْنُ سِنَانٍ عَنِ اَلْعَلاَءِ بْنِ فُضَيْلٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ: "إِنَّ اَلْوَلِيدَ وَ اَلطِّفْلَ لاَ يَحْجُبُكَ وَ لاَ يَرِثُكَ إِلاَّ مَنْ آذَنَ بِالصُّرَاخِ وَ لاَ شَيْءٌ أَكَنَّهُ اَلْبَطْنُ وَ إِنْ تَحَرَّكَ إِلاَّ مَا اِخْتَلَفَ عَلَيْهِ اَللَّيْلُ وَ اَلنَّهَارُ".

Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (a.s) said: "Indeed, a newborn or an infant does not prevent you (from inheritance) nor inherits from you unless they have cried aloud. Anything concealed in the womb, even if it moves, has no share in inheritance except what the passage of night and day might change."

Commentary 1

وَ لَا يَحْجُبُ الْأُمَّ عَنِ الثُّلُثِ الْإِخْوَةُ وَ الْأَخَوَاتُ مِنَ الْأُمِّ مَا بَلَغُوا وَ لَا يَحْجُبُهَا إِلَّا أَخَوَانِ أَوْ أَخٌ وَ أُخْتَانِ أَوْ أَرْبَعُ أَخَوَاتٍ لِأَبٍ أَوْ لِأَبٍ وَ أُمٍّ أَوْ أَكْثَرُ مِنْ ذَلِكَ وَ الْمَمْلُوكُ لَا يَحْجُبُ وَ لَا يَرِثُ.

Additionally, maternal siblings, regardless of their number, do not prevent the mother from receiving her one-third share. Only two full brothers, a brother with two sisters, or four full sisters (from the father or from both the father and mother) or more can reduce the mother's share. A servant neither prevents inheritance nor inherits.
