1ـ عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ رِفَاعَةَ بْنِ مُوسَى النَّخَّاسِ قَالَ سَأَلْتُ أَبَا الْحَسَنِ مُوسَى بْنَ جَعْفَرٍ (عَلَيْهِ الْسَّلام) قُلْتُ أَشْتَرِي الْجَارِيَةَ فَتَمْكُثُ عِنْدِي الأشْهُرَ لاَ تَطْمَثُ وَلَيْسَ ذَلِكَ مِنْ كِبَرٍ وَأُرِيهَا النِّسَاءَ فَيَقُلْنَ لِي لَيْسَ بِهَا حَبَلٌ فَلِي أَنْ أَنْكِحَهَا فِي فَرْجِهَا فَقَالَ إِنَّ الطَّمْثَ قَدْ تَحْبِسُهُ الرِّيحُ مِنْ غَيْرِ حَبَلٍ فَلاَ بَأْسَ أَنْ تَمَسَّهَا فِي الْفَرْجِ قُلْتُ فَإِنْ كَانَ بِهَا حَبَلٌ فَمَا لِي مِنْهَا قَالَ إِنْ أَرَدْتَ فِيمَا دُونَ الْفَرْجِ.

1. A number of our people have narrated from Ahmad ibn Muhammad from ibn Mahbub from Rifa‘ah ibn Musa al-Nakhkhas who has said the following: “I once asked Musa ibn Ja‘far (a.s.), about the case of a slave-girl I purchased. She lives with me for several months without experiencing Hayd (menses) but not because of old age. Other women examine her and tell me that she is not pregnant. Can I have intercourse with her? He (the Imam) said, ‘Hayd (menses) is sometimes blocked by air without pregnancy. It is not harmful if you touch her vagina? I then asked if she is pregnant what then? He (the Imam) said, ‘If you like you can benefit from other than vagina?” 

2ـ ابْنُ مَحْبُوبٍ عَنْ رِفَاعَةَ قَالَ قُلْتُ لأَبِي عَبْدِ الله (عَلَيْهِ الْسَّلام) أَشْتَرِي الْجَارِيَةَ فَرُبَّمَا احْتَبَسَ طَمْثُهَا مِنْ فَسَادِ دَمٍ أَوْ رِيحٍ فِي الرَّحِمِ فَتُسْقَى الدَّوَاءَ لِذَلِكَ فَتَطْمَثُ مِنْ يَوْمِهَا أَ فَيَجُوزُ لِي ذَلِكَ وَأَنَا لاَ أَدْرِي ذَلِكَ مِنْ حَبَلٍ هُوَ أَوْ مِنْ غَيْرِهِ فَقَالَ لِي لاَ تَفْعَلْ ذَلِكَ فَقُلْتُ لَهُ إِنَّهُ إِنَّمَا ارْتَفَعَ طَمْثُهَا مِنْهَا شَهْراً وَلَوْ كَانَ ذَلِكَ مِنْ حَبَلٍ إِنَّمَا كَانَ نُطْفَةً كَنُطْفَةِ الرَّجُلِ الَّذِي يَعْزِلُ فَقَالَ لِي إِنَّ النُّطْفَةَ إِذَا وَقَعَتْ فِي الرَّحِمِ تَصِيرُ إِلَى عَلَقَةٍ ثُمَّ إِلَى مُضْغَةٍ ثُمَّ إِلَى مَا شَاءَ الله وَإِنَّ النُّطْفَةَ إِذَا وَقَعَتْ فِي غَيْرِ الرَّحِمِ لَمْ يُخْلَقْ مِنْهَا شَيْ‏ءٌ فَلاَ تَسْقِهَا دَوَاءً إِذَا ارْتَفَعَ طَمْثُهَا شَهْراً وَجَازَ وَقْتُهَا الَّذِي كَانَتْ تَطْمَثُ فِيهِ.

2. Ibn Mahbub has narrated from Rifa’ah who has said the following: “I once said to abu ‘Abd Allah (a.s.), that I may purchase a slave-girl. Her Hayd (menses) stops because of spoiled blood or some kind of air in her womb, and she uses medicine for cure and her Hayd (menses) begins on the same day. I do not know if it is because of pregnancy or for other reasons, is it (use of medicine) permissible? He (the Imam) said, ‘You must not (allow to) do so? I then said that her Hayd (menses) has stopped for a month. Were it because of pregnancy, it would be a seed like the seed of man for which he may use contraceptives. He (the Imam) said, ‘If the seed falls inside the womb, it changes into a lump, then into flesh, then into what Allah wills. If the seed (semen) falls in places other than the womb nothing is created thereof. You must not give her medicine, when her Hayd (menses) stops, for a month and her time of Hayd (menses) passes?” (Fatwa best explains the above Hadith; it deals with several issues such as contraceptives, liability for abortion and the stages of fetuses.) 

3ـ مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ مَالِكِ بْنِ عَطِيَّةَ عَنْ دَاوُدَ بْنِ فَرْقَدٍ قَالَ سَأَلْتُ أَبَا عَبْدِ الله (عَلَيْهِ الْسَّلام) عَنْ رَجُلٍ اشْتَرَى جَارِيَةً مُدْرِكَةً وَلَمْ تَحِضْ عِنْدَهُ حَتَّى مَضَى لِذَلِكَ سِتَّةُ أَشْهُرٍ وَلَيْسَ بِهَا حَبَلٌ قَالَ إِنْ كَانَ مِثْلُهَا تَحِيضُ وَلَمْ يَكُنْ ذَلِكَ مِنْ كِبَرٍ فَهَذَا عَيْبٌ تُرَدُّ مِنْهُ. 

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ‘Abd Malik ibn ‘Atiyyah from Dawud ibn Farqad who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who buys a slave-girl who possesses awareness but does not experience Hayd (menses) while in his possession until six months and she is not pregnant. He (the Imam) said, ‘If slave-girls similar to her experience Hayd (menses) and it is not because of old age, it is a defect and a reason to revoke the contract of sale?”
