5003 - وَ فِي رِوَايَةِ اَلْحَلَبِيِّ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ : فِي رَجُلٍ وَقَعَ عَلَى مُكَاتَبَتِهِ فَقَالَ "إِنْ كَانَتْ أَدَّتِ اَلرُّبُعَ ضُرِبَ اَلْحَدَّ وَ إِنْ كَانَ مُحْصَناً رُجِمَ وَ إِنْ لَمْ يَكُنْ أَدَّتْ شَيْئاً فَلَيْسَ عَلَيْهِ شَيْءٌ".
Hadith.5003 - In the narration of Al-Halabi from Abu Abdullah 
, regarding a man who had intercourse with his slave woman who was in the process of being freed (mukatabah).
Imam said: "If she had paid a quarter of the contract, he is to be given the prescribed punishment (the hadd), and if he was married (muhsan), he is to be stoned. However, if she had not paid anything, then there is nothing upon him."
