Hadith #1

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ اشْتَرَى ثَوْباً وَلَمْ يَشْتَرِطْ عَلَى صَاحِبِهِ شَيْئاً فَكَرِهَهُ ثُمَّ رَدَّهُ عَلَى صَاحِبِهِ فَأَبَى أَنْ يَقْبَلَهُ إِلا بِوَضِيعَةٍ قَالَ لا يَصْلُحُ لَهُ أَنْ يَأْخُذَهُ بِوَضِيعَةٍ فَإِنْ جَهِلَ فَأَخَذَهُ وَبَاعَهُ بِأَكْثَرَ مِنْ ثَمَنِهِ رَدَّ عَلَى صَاحِبِهِ الأوَّلِ مَا زَادَ.

1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad ibn ‘Uthman from af-Halabiy who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who buys clothes without condition; then dislikes them and returns to the seller who does not accept the return without a certain amount of penalty. He (the Imam) said, ‘He cannot charge any penalty but if he did it because of ignorance and then sold it to someone for more, he must return the extra to the first owner.”



Hadith #2

2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ فِي رَجُلٍ قَالَ لِرَجُلٍ بِعْ ثَوْبِي بِعَشَرَةِ دَرَاهِمَ فَمَا فَضَلَ فَهُوَ لَكَ فَقَالَ لَيْسَ بِهِ بَأْسٌ.

2. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Muhammad ibn Muslim who has said the following: “About the case of a man who says to another man, ‘Sell my cloth for ten dirham, if you sold for more, then the extra is for you.’ He (the Imam) said, ‘It is not harmful.’”



Hadith #3

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ عَنْ أَبِي الصَّبَّاحِ الْكِنَانِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ يَحْمِلُ الْمَتَاعَ لأهْلِ السُّوقِ وَقَدْ قَوَّمُوهُ عَلَيْهِ قِيمَةً فَيَقُولُونَ بِعْ فَمَا ازْدَدْتَ فَلَكَ قَالَ لا بَأْسَ بِذَلِكَ وَلَكِنْ لا يَبِيعُهُمْ مُرَابَحَةً.

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from abu al-Sabbah al-Kinaniy who has said the following: “About the case of a man who carries goods for the people of a market who set a price on the goods and say, ‘If you sold for more, the extra is for you’, abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘It is not harmful but he cannot sell it for them on the basis of profit sharing.’”



Hadith #4

4- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَسَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ أَبِي وَلادٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَغَيْرِهِ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ لا بَأْسَ بِأَجْرِ السِّمْسَارِ إِنَّمَا يَشْتَرِي لِلنَّاسِ يَوْماً بَعْدَ يَوْمٍ بِشَيْ‏ءٍ مُسَمًّى إِنَّمَا هُوَ بِمَنْزِلَةِ الأجَرَاءِ.

4. A number of our people have narrated from Ahmad ibn Muhammad from and Sahl ibn Ziyad from ibn Mahbub from abu Wallad from abu ‘Abd Allah, ‘Alayhi al-Salam, and others from abu Ja‘far, ‘Alayhi al-Salam, who has said the following: “Abu Ja’far, ‘Alayhi al-Salam, has said, ‘Brokerage fee is not unlawful; he only buys for people every now and then for a known amount. He in fact works on hire.’”



Hadith #5

5- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ سَمَاعَةَ عَنْ غَيْرِ وَاحِدٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَبْدِ اللهِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ السِّمْسَارِ يَشْتَرِي بِالأجْرِ فَيُدْفَعُ إِلَيْهِ الْوَرِقُ وَيُشْتَرَطُ عَلَيْهِ أَنَّكَ إِنْ تَأْتِي بِمَا تَشْتَرِي فَمَإ؛ شِئْتُ تَرَكْتُهُ فَيَذْهَبُ فَيَشْتَرِي ثُمَّ يَأْتِي بِالْمَتَاعِ فَيَقُولُ خُذْ مَا رَضِيتَ وَدَعْ مَا كَرِهْتَ قَالَ لا بَأْسَ.

5. Humayd ibn Ziyad has narrated from Muhammad ibn Sama‘ah from more than one person from Aban ibn ‘Uthman from ‘Abd al- Rahman ibn abu ‘Abd Allah who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a broker who buys for a fee. Notes are given to him with the condition that he brings the merchandise and the buyer accepts whatever he likes and leaves the rest. He then brings the goods and says, ‘Take what you like and leave what you dislike.’ He (the Imam) said, ‘It is lawful.’”



Hadith #6

6- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ إِسْمَاعِيلَ بْنِ مَرَّارٍ عَنْ يُونُسَ عَنْ مُعَاوِيَةَ بْنِ عَمَّارٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ يَشْتَرِي الْجِرَابَ الْهَرَوِيَّ وَالْقُوهِيَّ فَيَشْتَرِي الرَّجُلُ مِنْهُ عَشَرَةَ أَثْوَابٍ فَيَشْتَرِطُ عَلَيْهِ خِيَارَهُ كُلَّ ثَوْبٍ بِرِبْحِ خَمْسَةٍ أَوْ أَقَلَّ أَوْ أَكْثَرَ فَقَالَ مَا أُحِبُّ هَذَا الْبَيْعَ أَرَأَيْتَ إِنْ لَمْ يَجِدْ خِيَاراً غَيْرَ خَمْسَةِ أَثْوَابٍ وَوَجَدَ الْبَقِيَّةَ سَوَاءً قَالَ لَهُ إِسْمَاعِيلُ ابْنُهُ إِنَّهُمْ قَدِ اشْتَرَطُوا عَلَيْهِ أَنْ يَأْخُذَ مِنْهُمْ عَشَرَةً فَرَدَّدَ عَلَيْهِ مِرَاراً فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِنَّمَا اشْتَرَطَ عَلَيْهِ أَنْ يَأْخُذَ خِيَارَهَا أَرَأَيْتَ إِنْ لَمْ يَكُنْ إِلا خَمْسَةَ أَثْوَابٍ وَوَجَدَ الْبَقِيَّةَ سَوَاءً وَقَالَ مَا أُحِبُّ هَذَا وَكَرِهَهُ لِمَوْضِعِ الْغَبْنِ.

6. Ali ibn Ibrahim has narrated from his father from ‘Isma’il ibn Marrar from Yunus from Mu‘awiyah ibn ‘Ammar who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who buys sacks made in Hirat, and in al-Quhiy. A man then buys from him ten cloths with the condition that he can choose every cloth, for a certain amount of profit, five or less or more. He (the Imam) said, ‘I do not like this sale. Consider if he cannot find in choosing anything other than five cloths and finds the rest the same.’ Imam’s son, ‘Isma’il said, ‘They have set a condition on him to take ten pieces’ and he repeated it several times. He (the Imam) said, ‘He has set up a condition to take the best. Consider if there is nothing more than five cloths and he finds the rest the same.’ He (the Imam) said, ‘I do not like this deal.’ He (the Imam) disliked it because of one party’s suffering loss.’”



Hadith #7

7- مُحَمَّدُ بْنُ يَحْيَى عَنْ بَعْضِ أَصْحَابِهِ عَنِ الْحُسَيْنِ بْنِ الْحَسَنِ عَنْ حَمَّادٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ يُكْرَهُ أَنْ يُشْتَرَى الثَّوْبُ بِدِينَارٍ غَيْرَ دِرْهَمٍ لأنَّهُ لا يُدْرَى كَمِ الدِّينَارُ مِنَ الدِّرْهَمِ.

7. Muhammad ibn Yahya has narrated from certain persons of his people from al-Husayn ibn al-Hassan from Hammad who have said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘It is undesirable to buy something with dinar which is other than (a particular) dirham because he does not know the value of dinar in relation to the dirham.’”
