Hadith 1

مُحَمَّدُ بْنُ يَعْقُوبَ عَنْ عِدَّةٍ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ اِبْنِ مَحْبُوبٍ عَنْ هِشَامِ بْنِ سَالِمٍ عَنْ بُرَيْدٍ اَلْعِجْلِيِّ قَالَ: سُئِلَ أَبُو جَعْفَرٍ عَلَيْهِ اَلسَّلاَمُ عَنْ رَجُلٍ شَهِدَ عَلَيْهِ شُهُودٌ أَنَّهُ أَ فْطَرَ مِنْ شَهْرِ رَمَضَانَ ثَلاَثَةَ أَيَّامٍ قَالَ» يُسْأَلُ هَلْ عَلَيْكَ مِنْ إِفْطَارِكَ فِي شَهْرِ رَمَضَانَ إِثْمٌ فَإِنْ قَالَ لاَ فَإِنَّ عَلَى اَلْإِمَامِ أَنْ يَقْتُلَهُ وَ إِنْ قَا لَ نَعَمْ فَإِنَّ عَلَى اَلْإِمَامِ أَنْ يَنْهَكَهُ ضَرْباً«.

Muhammad ibn Yaqub, from a number of our companions, from Ahmad ibn Muhammad, from Ibn Mahbub, from Hisham ibn Salim, from Burayd al-Ijli, who said: Abu Ja’far (a.s), peace be upon him, was asked about ‘a man against whom witnesses testified that he broke his fast for three days from the month of Ramadan.’ Imam (a.s) said: “This man is asked, ‘Is there any sin upon you for your breaking the fast in the month of Ramadan?’ If he says, ‘No,’ then upon the Imam is that he kill him. And if he says, ‘Yes,’ then upon the Imam is that he severely beat him.”

Hadith 2

وَ عَنْهُ عَنْ عَلِيِّ بْنِ مُحَمَّدِ بْنِ بُنْدَارَ عَنْ إِبْرَاهِيمَ بْنِ إِسْحَاقَ اَلْأَحْمَرِ عَنْ عَبْدِ اَللَّهِ بْنِ حَمَّادٍ عَنِ اَلْمُفَضَّلِ بْنِ عُمَرَ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ: فِي رَجُلٍ أَتَى اِمْرَأَتَهُ وَهُوَ صَائِمٌ وَهِيَ صَائِمَةٌ فَقَالَ» إِنْ كَانَ اِسْتَكْرَهَهَا فَعَلَيْهِ كَفَّارَتَانِ وَ إِنْ كَانَتْ طَاوَعَتْهُ فَعَلَيْهِ كَفَّارَةٌ وَ عَلَيْهَا كَفَّارَةٌ وَ إِنْ كَانَ أَكْرَهَهَا فَعَلَيْهِ ضَرْبُ خَمْسِينَ سَوْطاً نِصْفِ اَلْحَدِّ وَ إِنْ كَانَتْ طَاوَعَتْهُ ضُرِبَ خَمْسَةً وَ عِشْرِينَ سَوْطاً وَضُرِبَتْ خَمْسَةً وَ عِشْرِينَ سَوْطاً«.

And from him, from Ali ibn Muhammad ibn Bundar, from Ibrahim ibn Ishaq al-Ahmar, from Abdullah ibn Hammad, from al-Mufaddal ibn Umar, from Abu Abdillah (a.s), peace be upon him: (Imam (a.s) was asked) regarding ‘a man who came to his wife (for intimate relations) while he was fasting and she was fasting.’ Imam (a.s) said: “If he compelled her, then upon him are two expiations. And if she obeyed him willingly, then upon him is an expiation and upon her is an expiation. And if he forced her, then upon him is the striking of fifty lashes, half the prescribed punishment. And if she obeyed him willingly, he is struck twenty-five lashes, and she is struck twenty-five lashes.”
