Ḥadīth 5229

5229 - وَ رَوَى اِبْنُ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ اَلْحَكَمِ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ : فِي اَلرَّجُلِ يَجْنِي فِي غَيْرِ اَلْحَرَمِ ثُمَّ يَلْجَأُ إِلَى اَلْحَرَمِ قَالَ "لاَ يُقَامُ عَلَيْهِ اَلْحَدُّ وَ لاَ يُطْعَمُ وَ لاَ يُسْقَى وَ لاَ يُكَلَّمُ وَ لاَ يُبَايَعُ فَإِنَّهُ إِذَا فُعِلَ ذَلِكَ بِهِ يُوشِكُ أَنْ يَخْرُجَ فَيُقَامَ عَلَيْهِ اَلْحَدُّ وَ إِنْ جَنَى فِي اَلْحَرَمِ جِنَايَةً أُقِيمَ عَلَيْهِ اَلْحَدُّ فِي اَلْحَرَمِ فَإِنَّهُ لَمْ يَرَ لِلْحَرَمِ حُرْمَةً".

Hadith.5229 - Ibn Abi Umayr narrated from Hisham ibn Al-Hakam from Abu Abdullah (as) regarding a man who commits a crime outside the Sacred Sanctuary (Al-Haram) and then seeks refuge within it. Imam (as) said: "The legal punishment (hadd) is not to be carried out on him, but he should not be given food or drink, nor spoken to, nor engaged in trade. By doing this to him, it is likely that he will leave, and then the punishment can be enforced upon him. However, if he commits a crime within the Sacred Sanctuary, the legal punishment must be carried out on him within the Haram, for he has shown no respect for its sanctity."
