Ḥadīth 5712

5712 - رَوَى اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنْ أَبِي وَلاَّدٍ اَلْحَنَّاطِ قَالَ : سَأَلْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنْ رَجُلٍ اِرْتَدَّ عَنِ اَلْإِسْلاَمِ لِمَنْ يَكُونُ مِيرَاثُهُ قَالَ "يُقْسَمُ مِيرَاثُهُ عَلَى وَرَثَتِهِ عَلَى كِتَابِ اَللَّهِ عَزَّ وَ جَلَّ".

Hadith.5712 - Al-Hasan ibn Mahbub narrated from Abu Walad Al-Hannat who said: I asked Abu Abdullah (as) about a man who apostatized from Islam. To whom does his inheritance go? Imam (as) said: "His inheritance is divided among his heirs according to the Book of Allah (swt), the Mighty and Majestic."

Ḥadīth 5713

5713 - وَ رَوَى اَلْحَسَنُ بْنُ مَحْبُوبٍ عَنْ سَيْفِ بْنِ عَمِيرَةَ عَنْ أَبِي بَكْرٍ اَلْحَضْرَمِيِّ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ قَالَ : "إِذَا اِرْتَدَّ اَلرَّجُلُ اَلْمُسْلِمُ عَنِ اَلْإِسْلاَمِ بَانَتْ مِنْهُ اِمْرَأَتُهُ كَمَا تَبِينُ اَلْمُطَلَّقَةُ ثَلاَثاً وَ تَعْتَدُّ مِنْهُ كَمَا تَعْتَدُّ اَلْمُطَلَّقَةُ فَإِنْ رَجَعَ إِلَى اَلْإِسْلاَمِ وَ تَابَ قَبْلَ أَنْ تَتَزَوَّجَ فَهُوَ خَاطِبٌ وَ لاَ عِدَّةَ عَلَيْهَا لَهُ وَ إِنَّمَا عَلَيْهَا اَلْعِدَّةُ لِغَيْرِهِ فَإِنْ قُتِلَ أَوْ مَاتَ قَبْلَ اِنْقِضَاءِ اَلْعِدَّةِ اِعْتَدَّتْ مِنْهُ عِدَّةَ اَلْمُتَوَفَّى عَنْهَا زَوْجُهَا فَهِيَ تَرِثُهُ فِي اَلْعِدَّةِ وَ لاَ يَرِثُهَا إِنْ مَاتَتْ وَ هُوَ مُرْتَدٌّ عَنِ اَلْإِسْلاَمِ ".

Hadith.5713 - Al-Hasan ibn Mahbub narrated from Sayf ibn Umayrah from Abu Bakr Al-Hadrami from Abu Abdullah (as) who said: "If a Muslim man apostatizes from Islam, his wife becomes separated from him just as a woman becomes separated after a third divorce, and she must observe the waiting period (iddah) as a divorced woman does. If he returns to Islam and repents before she marries another man, he may propose to her again, and she is not required to observe any waiting period for him, though she must observe it for anyone else. However, if he is killed or dies before the completion of her waiting period, she must observe the waiting period of a widow (iddah of a deceased husband), and during that period, she inherits from him. But if she dies while he is still an apostate, he does not inherit from her."
